  1  1    Section 1.  Section 376.4, unnumbered paragraph 1, Code
  1  2 1995, is amended to read as follows:
  1  3    An eligible elector of a city may become a candidate for an
  1  4 elective city office by filing with the city clerk a valid
  1  5 petition requesting that the elector's name be placed on the
  1  6 ballot for that office.  The petition must be filed not more
  1  7 than seventy-one days nor and not less than forty-seven days
  1  8 before the date of the election, and must be signed by
  1  9 eligible electors equal in number to at least two percent of
  1 10 those who voted to fill the same office at the last regular
  1 11 city election, but not less than ten persons.  However, for
  1 12 those cities which may be required to hold a primary election,
  1 13 the petition must be filed not more than eighty-five days and
  1 14 not less than sixty-eight days before the date of the regular
  1 15 city election.  A person may sign nomination petitions for
  1 16 more than one candidate for the same office, and the signature
  1 17 is not invalid solely because the person signed nomination
  1 18 petitions for one or more other candidates for the office.
  1 19 Nomination petitions shall be filed not later than five
  1 20 o'clock p.m.  on the last day for filing.  
  1 21                           EXPLANATION
  1 22    This bill extends from 47 days to 68 days the candidate
  1 23 filing deadline for candidates in city elections where the
  1 24 city is required to hold a primary election.  A city may
  1 25 provide by ordinance to hold runoff elections or to allow
  1 26 nominations of candidates in the same manner as nonpolitical
  1 27 party organizations.  In the absence of either ordinance, a
  1 28 city is required to hold a primary election if the number of
  1 29 candidates filing valid nomination petitions for an office is
  1 30 at least twice the number of positions to be filled.
