PAG LIN 1 1 Section 1. NEW SECTION. 28E.41 EMERGENCY SERVICES &endash; 1 2 CONTRACTS FOR MUTUAL AID. 1 3 1. A city fire department, benefitted fire district, or 1 4 township fire department may enter into contracts providing 1 5 for mutual aid regarding emergency services provided by such 1 6 department or district. The contracts that are agreed upon 1 7 may provide for compensation from the parties and other terms 1 8 that are agreeable to the parties and may be for an indefinite 1 9 period as long as they include a sixty-day cancellation notice 1 10 by any party. The contracts agreed upon shall not be entered 1 11 into for the purpose of reducing the number of employees of 1 12 any party. 1 13 2. A city fire department, benefitted fire district, or 1 14 township fire department may provide assistance to any other 1 15 such department or district in the state at the time of a 1 16 significant emergency such as a fire, earthquake, flood, 1 17 tornado, hazardous material incident, or other such disaster. 1 18 The chief or highest ranking fire officer of an assisting 1 19 department or district may render aid to a requesting 1 20 department or district as long as the chief or officer is 1 21 acting in accordance with the policies and procedures set 1 22 forth by the governing board of the assisting department or 1 23 district. 1 24 3. The chief or highest ranking officer of the city fire 1 25 department, benefitted fire district, or township fire 1 26 department of the district within which the incident occurs 1 27 shall be the incident commander. The chief or highest ranking 1 28 officer of the department or district giving mutual aid shall 1 29 be in charge of the assisting departmental or district 1 30 personnel. 1 31 EXPLANATION 1 32 This bill provides that any city fire department, 1 33 benefitted fire district, or township fire department, may 1 34 enter into mutual aid agreements concerning emergency services 1 35 provided by that department or district. The bill provides 2 1 that in rendering assistance for a disaster pursuant to a 2 2 mutual aid agreement, the chief of the fire department or 2 3 district where the incident occurred shall be considered the 2 4 incident commander and the chief of the assisting department 2 5 or district shall only be responsible for the assisting 2 6 department's or district's personnel. 2 7 LSB 3661HH 76 2 8 ec/sc/14
