1 1 Section 1. Section 7E.3, Code 1995, is amended by adding
1 2 the following new subsection:
1 3 NEW SUBSECTION. 3A. SCHEDULE FOR PROCESSING APPLICATIONS.
1 4 Establish by rule, adopted pursuant to chapter 17A, a schedule
1 5 for approving or disapproving each application, or class of
1 6 applications, for a permit or license requiring approval by
1 7 the department or independent agency. If the department or
1 8 independent agency fails to either approve or disapprove the
1 9 license or permit within the period established by the
1 10 schedule, the rules shall provide for a prompt refund of the
1 11 amount of any fee paid for the permit or license. The period
1 12 for calculating days in a schedule shall not include any day
1 13 for which an applicant or registrant is required to furnish
1 14 information to the department or independent agency in order
1 15 to complete its action. The department or independent agency
1 16 shall establish a schedule for the accelerated approval or
1 17 disapproval of an application, or class of applications, for a
1 18 permit or license requiring approval by the department or
1 19 independent agency. The department or independent agency may
1 20 charge an applicant an increased fee for accelerating
1 21 consideration of the application.
1 22 EXPLANATION
1 23 This bill requires each department and independent agency
1 24 to adopt rules establishing a schedule for approving or
1 25 disapproving applications for permits or licenses. The bill
1 26 provides that if a department or independent agency fails to
1 27 either approve or disapprove the license or permit within the
1 28 period established by the schedule, the department or agency
1 29 must provide for a prompt refund of the amount of any fee paid
1 30 for the permit or license. The period for calculating days in
1 31 a schedule does not include any day for which an applicant or
1 32 registrant is required to furnish information to the
1 33 department or independent agency in order to complete its
1 34 action. The bill requires the department or independent
1 35 agency to establish a schedule for the accelerated approval or
