1 1 Section 1. NEW SECTION. 455A.12 STATE FISH AND GAME
1 2 PROTECTION FUND &endash; REIMBURSEMENT FOR MOTOR VEHICLE COLLISION
1 3 CLAIMS.
1 4 If a motor vehicle is involved in a collision with a deer,
1 5 the motor vehicle owner may receive not more than one hundred
1 6 dollars, payable from the state fish and game protection fund
1 7 created in section 456A.17. The claimant shall apply and the
1 8 department shall pay the claim as provided in rules adopted by
1 9 the department pursuant to chapter 17A. The rules shall
1 10 require that the claimant provide evidence demonstrating that
1 11 the collision was caused by a deer and a verified amount of
1 12 the damage or injury. However, a claim shall not be paid if
1 13 the collision was caused intentionally or by negligence or
1 14 recklessness of the motor vehicle operator.
1 15 EXPLANATION
1 16 This bill provides that if a motor vehicle is involved in a
1 17 collision with a deer, the motor vehicle owner may receive not
1 18 more than $100, payable from the state fish and game
1 19 protection fund created in section 456A.17. The claimant must
1 20 apply to the department of natural resources for compensation.
1 21 A claim is not eligible, if the collision was caused
1 22 intentionally or by negligence or recklessness by the motor
1 23 vehicle operator.
