1 1 Section 1. NEW SECTION. 514C.11 MINIMUM POSTDELIVERY
1 2 CARE REQUIREMENTS.
1 3 1. Notwithstanding section 514C.6, an individual or group
1 4 policy of accident or health insurance or individual or group
1 5 hospital or health care service contract issued pursuant to
1 6 chapter 509, 514, or 514A or an individual or group health
1 7 maintenance organization contract issued and regulated under
1 8 chapter 514B, which is delivered, amended, or renewed on or
1 9 after July 1, 1996, and which provides maternity benefits,
1 10 shall provide coverage for a minimum of forty-eight hours of
1 11 inpatient care following a vaginal delivery and a minimum of
1 12 ninety-six hours of inpatient care following a cesarean
1 13 section for the insured mother and newly born child in a
1 14 hospital licensed pursuant to chapter 135B. However, if in-
1 15 home services as described in subsections 2 and 3, are
1 16 provided in lieu of the required inpatient care, coverage
1 17 shall be provided for the in-home services.
1 18 2. Notwithstanding the requirement of the provision of
1 19 inpatient care pursuant to subsection 1, if a licensed
1 20 hospital provides for postdelivery care to a mother and the
1 21 mother's newly born child in the home of the mother and newly
1 22 born child, the licensed hospital may provide in-home services
1 23 in lieu of the required inpatient care. However, if a
1 24 licensed hospital provides in-home services but the attending
1 25 provider determines that inpatient care is necessary or the
1 26 mother requests the minimum hours of inpatient care, the
1 27 inpatient care requirements of subsection 1 shall apply.
1 28 3. If in-home services are provided in lieu of inpatient
1 29 care, the services shall include but are not limited to parent
1 30 education, assistance and training in breast or bottle
1 31 feeding, and the performance of any necessary and appropriate
1 32 clinical tests. The services shall include at least three
1 33 follow-up visits to be provided within the twenty-four-hour
1 34 period, between the twenty-five and forty-eight-hour period
1 35 for vaginal deliveries, and between the forty-nine and ninety-
2 1 six hour period for cesarean sections following discharge of
2 2 the mother and the newly born child. The in-home services
2 3 shall be provided by a registered nurse with a minimum of
2 4 three years of experience in community maternal and child
2 5 health nursing.
2 6 4. The commissioner of insurance shall adopt rules to
2 7 implement this section and the department of inspections and
2 8 appeals shall inform each licensed hospital of the
2 9 requirements of this section, in writing.
2 10 5. For the purposes of this section, "attending provider"
2 11 means a pediatrician or other licensed physician attending the
2 12 newly born child, or an obstetrician, certified nurse-midwife,
2 13 or other physician attending the mother.
2 14 EXPLANATION
2 15 This bill requires that an individual or group policy of
2 16 accident or health insurance, an individual or group hospital
2 17 or health care service contract, or an individual or group
2 18 health maintenance organization contract, which is delivered,
2 19 amended, or renewed on or after July 1, 1996, and which
2 20 provides maternity benefits, is to provide a minimum of 48
2 21 hours of inpatient care following a vaginal delivery and a
2 22 minimum of 96 hours of inpatient care following a cesarean
2 23 section for an insured mother and the newly born child, in a
2 24 licensed hospital. The bill also provides that if in-home
2 25 services as described in the bill are provided in lieu of the
2 26 required postdelivery inpatient care, coverage is to be
2 27 provided for those in-home services. The bill also provides
2 28 that if the hospital provides for in-home services following
2 29 delivery of a child, the in-home services may be provided in
2 30 lieu of the inpatient care. However, if the attending
2 31 provider determines or the mother requests inpatient care, the
2 32 hospital is required to comply with at least the minimum care
2 33 requirements. The bill specifies the type of in-home services
2 34 which must be provided, the time frame requirements for
2 35 provision of services, and specifies that the services must be
3 1 provided by a registered nurse with at least three years of
3 2 experience in community maternal and child health nursing.
3 3 The bill directs the commissioner of insurance to adopt rules
3 4 to implement the bill and the department of inspections and
3 5 appeals to inform licensed hospitals of the requirements of
3 6 the bill.
