PAG LIN 1 1 Section 1. Section 902.8, Code 1995, is amended to read as 1 2 follows: 1 3 902.8 MINIMUM SENTENCE &endash; HABITUAL OFFENDER. 1 4 An habitual offender is any person convicted of a class "C" 1 5 or a class "D" felony, who has twice before been convicted of 1 6 any felony in a court of this or any other state, or of the 1 7 United States. An offense is a felony if, by the law under 1 8 which the person is convicted, it is so classified at the time 1 9 of the person's conviction. A person sentenced as an habitual 1 10 offender for the commission of a class "D" felony shall not be 1 11 eligible for parole until the person has served the minimum 1 12 sentence of confinement of three years. A person sentenced as 1 13 an habitual offender for the commission of a class "C" felony 1 14 shall not be eligible for parole until the person has served 1 15 the minimum sentence of confinement of five years. 1 16 EXPLANATION 1 17 This bill provides that a person sentenced as an habitual 1 18 offender for a class "C" felony shall serve at least five 1 19 years in prison prior to being eligible for parole. An 1 20 habitual offender is a person who commits three felonies. The 1 21 minimum sentence for an habitual offender sentenced for a 1 22 class "D" felony remains three years under this bill. 1 23 LSB 3040HH 76 1 24 mk/jw/5
