The salary rates specified in subsection 2 are 1 4 effective for the fiscal year beginning July 1, 1995, with the 1 5 pay period beginning June 30, 1995, and for subsequent fiscal 1 6 years until otherwise provided by the general assembly. The 1 7 salaries provided for in this section shall be paid from funds 1 8 appropriated to the judicial department from the salary 1 9 adjustment fund or if the appropriation is not sufficient, 1 10 from the funds appropriated to the judicial department 1 11 pursuant to any Act of the general assembly. 1 12 2. SALARY RATE LIMITS. Persons receiving the salary 2 3 rates established under section 1 of this Act shall not 2 4 receive any additional salary adjustments provided by this 2 5 Act. 2 6 Sec. 3. ELECTIVE EXECUTIVE OFFICIALS. 2 7 1. The annual salary rates specified in this section are 2 8 effective for the fiscal year beginning July 1, 1995, with the 2 9 pay period beginning June 30, 1995, and for subsequent fiscal 2 10 years until otherwise provided by the general assembly. The 2 11 salaries provided for in this section shall be paid from funds 2 12 appropriated to the department or agency specified in this 2 13 section pursuant to any Act of the general assembly or if the 2 14 appropriation is not sufficient, from the salary adjustment 2 15 fund. 2 16 2. The following annual salary rates shall be paid to the 2 17 person holding the position indicated: 2 18 a. OFFICE OF THE TREASURER OF STATE 3 2 Salary for the treasurer of state: 3 3 .................................................. $ 78,050 3 4 Sec. 4. APPOINTED STATE OFFICERS. The governor shall 3 5 establish a salary for appointed nonelected persons in the 3 6 executive branch of state government holding a position 3 7 enumerated in section 5 of this Act within the range provided, 3 8 by considering, among other items, the experience of the 3 9 individual in the position, changes in the duties of the 3 10 position, the incumbent's performance of assigned duties, and 3 11 subordinates' salaries. However, the attorney general shall 3 12 establish the salary for the consumer advocate, the chief 3 13 justice of the state supreme court shall establish the salary 3 14 for the state court administrator, and the state fair board 3 15 shall establish the salary of the secretary of the state fair 3 16 board, each within the salary range provided in section 5 of 3 17 this Act. 3 18 The governor, in establishing salaries as provided in 3 19 section 5 of this Act, shall take into consideration other 3 20 employee benefits which may be provided for an individual 3 21 including, but not limited to, housing. 3 22 A person whose salary is established pursuant to section 5 3 23 of this Act and who is a full-time permanent employee of the 3 24 state shall not receive any other remuneration from the state 3 25 or from any other source for the performance of that person's 3 26 duties unless the additional remuneration is first approved by 3 27 the governor or authorized by law. However, this provision 3 28 does not exclude the reimbursement for necessary travel and 3 29 expenses incurred in the performance of duties or fringe 3 30 benefits normally provided to employees of the state. 3 31 Sec. 5. STATE OFFICERS &endash; SALARY RATES AND RANGES. The 3 32 following annual salary ranges are effective for the positions 3 33 specified in this section for the fiscal year beginning July 3 34 1, 1995, with the pay period beginning June 30, 1995, and for 3 35 subsequent fiscal years until otherwise provided by the 4 1 general assembly. The governor or other person designated in 4 2 section 4 of this Act shall determine the salary to be paid to 4 3 the person indicated at a rate within the salary ranges 4 4 indicated from funds appropriated by the general assembly for 4 5 that purpose. 4 6 1. The following are range 2 positions: administrator of 4 16 the arts division of the department of cultural affairs, 4 17 administrators of the division of persons with disabilities, 4 18 the division on the status of women, the division on the 4 19 status of African-Americans, the division for deaf services, 4 20 and the division of Latino affairs of the department of human 4 21 rights, administrator of the division of professional 4 22 licensing and regulation of the department of commerce, 4 23 executive director of the commission of veterans affairs, and 4 24 administrator of the division of emergency management of the 4 25 department of public defense. 4 26 4. The following are range 3 positions: administrator of 4 27 criminal and juvenile justice planning of the department of 4 28 human rights, administrator of the division of community 4 29 action agencies of the department of human rights, and 4 30 chairperson and members of the employment appeal board of the 4 31 department of inspections and appeals. 4 32 5. The following are range 4 positions: superintendent of 4 33 banking, superintendent of credit unions, drug abuse 4 34 prevention coordinator, administrator of the alcoholic 4 35 beverages division of the department of commerce, state public 5 1 defender, and chairperson and members of the board of parole. 5 2 6. The following are range 5 positions: consumer 5 3 advocate, job service commissioner, labor commissioner, 5 4 industrial commissioner, administrator of the historical 5 5 division of the department of cultural affairs, administrator 5 6 of the public broadcasting division of the department of 5 7 education, the administrator of the state racing and gaming 5 8 commission of the department of inspections and appeals, 5 9 commandant of the veterans home, and secretary of the state 5 10 fair board. 5 11 7. The following are range 7 positions: director of the 5 24 department of cultural affairs, director of the department of 5 25 personnel, director of public health, executive director of 5 26 the department of elder affairs, commissioner of public 5 27 safety, director of the department of general services, 5 28 director of the department of commerce, director of the law 5 29 enforcement academy, and director of the department of 5 30 inspections and appeals. 5 31 10. The following are range 8 positions: commissioner of 5 32 insurance, executive director of the Iowa finance authority, 5 33 director of revenue and finance, director of the department of 5 34 natural resources, director of the department of corrections, 5 35 director of the department of employment services, and 6 1 chairperson of the utilities board. The other members of the 6 2 utilities board shall receive an annual salary within a range 6 3 of not less than ninety percent but not more than ninety-five 6 4 percent of the annual salary of the chairperson of the 6 5 utilities board. 6 6 11. The following are range 9 positions: director of the 6 7 department of education, director of human services, director 6 8 of the department of economic development, executive director 6 9 of the state board of regents, director of the state 6 10 department of transportation, lottery commissioner, the state 6 11 court administrator, and the director of the department of 6 12 management. 6 13 Sec. 6. PUBLIC EMPLOYMENT RELATIONS BOARD. 6 14 1. The salary rates specified in this section are 6 15 effective for the fiscal year beginning July 1, 1995, with the 6 16 pay period beginning June 30, 1995, and for subsequent fiscal 6 17 years until otherwise provided by the general assembly. The 6 18 salaries provided for in this section shall be paid from funds 6 19 appropriated to the public employment relations board from the 6 20 salary adjustment fund, or if the appropriation is not 6 21 sufficient from funds appropriated to the public employment 6 22 relations board pursuant to any other Act of the general 6 23 assembly. 6 24 2. The following annual salary rates shall be paid to the 6 25 persons holding the positions indicated: 6 26 a. Chairperson of the public employment relations board: 6 27 .................................................. $ 59,600 6 28 b. Two members of the public employment relations board: 6 29 .................................................. $ 55,400 6 30 Sec. 7. COLLECTIVE BARGAINING AGREEMENTS FUNDED &endash; GENERAL 6 31 FUND. There is appropriated from the general fund of the 6 32 state to the salary adjustment fund for the fiscal year 6 33 beginning July 1, 1995, and ending June 30, 1996, for 6 34 distribution by the department of management to the various 6 35 state departments, boards, commissions, councils, and 7 1 agencies, including the state board of regents, the amount of 7 2 $34,700,000, or so much thereof as may be necessary, to fully 7 3 fund the following annual pay adjustments, expense 7 4 reimbursements, and related benefits: 7 5 1. The collective bargaining agreement negotiated pursuant 7 6 to chapter 20 for employees in the blue collar bargaining 7 7 unit. 7 8 2. The collective bargaining agreement negotiated pursuant 7 9 to chapter 20 for employees in the public safety bargaining 7 10 unit. 7 11 3. The collective bargaining agreement negotiated pursuant 7 12 to chapter 20 for employees in the security bargaining unit. 7 13 4. The collective bargaining agreement negotiated pursuant 7 14 to chapter 20 for employees in the technical bargaining unit. 7 15 5. The collective bargaining agreement negotiated pursuant 7 16 to chapter 20 for employees in the professional fiscal and 7 17 staff bargaining unit. 7 18 6. The collective bargaining agreement negotiated pursuant 7 19 to chapter 20 for employees in the university of northern Iowa 7 20 faculty bargaining unit. 7 21 7. The collective bargaining agreement negotiated pursuant 7 22 to chapter 20 for employees in the clerical bargaining unit. 7 23 8. The collective bargaining agreement negotiated pursuant 7 24 to chapter 20 for employees in the professional social 7 25 services bargaining unit. 7 26 9. The collective bargaining agreement negotiated pursuant 7 27 to chapter 20 for employees in the community-based corrections 7 28 bargaining unit. 7 29 10. The collective bargaining agreement negotiated 7 30 pursuant to chapter 20 for employees in the judicial branch of 7 31 government bargaining unit. 7 32 11. The collective bargaining agreement negotiated 7 33 pursuant to chapter 20 for employees in the patient care 7 34 bargaining unit. 7 35 12. The collective bargaining agreement negotiated 8 1 pursuant to chapter 20 for employees in the science bargaining 8 2 unit. 8 3 13. The annual pay adjustments, related benefits, and 8 4 expense reimbursements referred to in sections 8 and 9 of this 8 5 Act for employees not covered by a collective bargaining 8 6 agreement. 8 7 Sec. 8. NONCONTRACT STATE EMPLOYEES &endash; GENERAL. 8 8 1. a. For the fiscal year beginning July 1, 1995, the 8 9 maximum salary levels of all pay plans provided for in section 8 10 19A.9, subsection 2, as they exist for the fiscal year ending 8 11 June 30, 1995, shall be increased by 3 percent for the pay 8 12 period beginning June 30, 1995. 8 13 b. In addition to the increases specified in this 8 14 subsection, for the fiscal year beginning July 1, 1995, 8 15 employees may receive a merit increase or the equivalent of a 8 16 merit increase. 8 17 2. The pay plans for state employees who are exempt from 8 18 chapter 19A and who are included in the department of revenue 8 19 and finance's centralized payroll system shall be increased in 8 20 the same manner as provided in subsection 1. 8 21 3. This section does not apply to members of the general 8 22 assembly, board members, commission members, salaries of 8 23 persons set by the general assembly pursuant to this Act, or 8 24 set by the governor, employees designated under section 19A.3, 8 25 subsection 5, and employees covered by 581 IAC 4.5(17). 8 26 4. The pay plans for the bargaining eligible employees of 8 27 the state shall be increased in the same manner as provided in 8 28 subsection 1. As used in this section, "bargaining eligible 8 29 employee" means an employee who is eligible to organize under 8 30 chapter 20, but has not done so. 8 31 5. The policies for implementation of this section shall 8 32 be approved by the governor. 8 33 Sec. 9. STATE EMPLOYEES &endash; STATE BOARD OF REGENTS. Funds 8 34 from the appropriation in section 7 of this Act shall be 8 35 allocated to the state board of regents for the purposes of 9 1 providing increases for state board of regents employees 9 2 covered by section 7 of this Act and for employees not covered 9 3 by a collective bargaining agreement as follows: 9 4 1. For regents merit system employees to fund for the 9 5 fiscal year beginning July 1, 1995, increases comparable to 9 6 those provided for similar contract-covered employees in this 9 7 Act. 9 8 2. For faculty members and professional and scientific 9 9 employees to fund for the fiscal year beginning July 1, 1995, 9 10 percentage increases comparable to those provided for 9 11 contract-covered employees in section 7, subsection 6, of this 9 12 Act. 9 13 Sec. 10. APPROPRIATIONS FROM ROAD FUNDS. 9 14 1. There is appropriated from the road use tax fund to the 9 15 salary adjustment fund for the fiscal year beginning July 1, 9 16 1995, and ending June 30, 1996, the following amount, or so 9 17 much thereof as may be necessary, to be used for the purpose 9 18 designated: 9 19 To supplement other funds appropriated by the general 9 20 assembly: 9 21 .................................................. $ 1,246,687 9 22 2. There is appropriated from the primary road fund to the 9 23 salary adjustment fund, for the fiscal year beginning July 1, 9 24 1995, and ending June 30, 1996, the following amount, or so 9 25 much thereof as may be necessary, to be used for the purpose 9 26 designated: 9 27 To supplement other funds appropriated by the general 9 28 assembly: 9 29 .................................................. $ 3,055,214 9 30 3. Except as otherwise provided in this Act, the amounts 9 31 appropriated in subsections 1 and 2 shall be used to fund the 9 32 annual pay adjustments, expense reimbursements, and related 9 33 benefits for public employees as provided in this Act. 9 34 Sec. 11. SPECIAL FUNDS &endash; AUTHORIZATION. To departmental 9 35 revolving, trust, or special funds, except for the primary 10 1 road fund or the road use tax fund, for which the general 10 2 assembly has established an operating budget, a supplemental 10 3 expenditure authorization is provided, unless otherwise 10 4 provided, in an amount necessary to fund salary adjustments as 10 5 otherwise provided in this Act. 10 6 Sec. 12. GENERAL FUND SALARY MONEYS. Funds appropriated 10 7 from the general fund of the state in this Act relate only to 10 8 salaries supported from general fund appropriations of the 10 9 state except for employees of the state board of regents. It 10 10 is the intent of the general assembly that the department of 10 11 management and the legislative fiscal bureau in conjunction 10 12 with the state agency affected by this section to prepare 10 13 recommendations concerning the application of this section to 10 14 the general assembly not later than February 1, 1996. 10 15 Sec. 13. FEDERAL FUNDS APPROPRIATED. All federal grants 10 16 to and the federal receipts of the agencies affected by this 10 17 Act which are received and may be expended for purposes of 10 18 this Act are appropriated for those purposes and as set forth 10 19 in the federal grants or receipts. 10 20 Sec. 14. Section 2.10, subsections 1, 3, 6, and 7, Code 10 21 1995, are amended to read as follows: 10 22 1. Every member of the general assembly except the 10 23 presiding officer of the senate, the speaker of the house, the 10 24 majority and minority floor leader of each house, and the 10 25 president pro tempore of the senate and speaker pro tempore of 10 26 the house, shall receive an annual salary ofeighteentwenty 10 27 thousandeightone hundred twenty dollars for the year199510 28 1997 and subsequent years while serving as a member of the 10 29 general assembly. In addition, each such member shall receive 10 30 the sum ofsixtyeighty-six dollars per day for expenses of 10 31 office, except travel, for each day the general assembly is in 10 32 session commencing with the first day of a legislative session 10 33 and ending with the day of final adjournment of each 10 34 legislative session as indicated by the journals of the house 10 35 and senate, except that if the length of the first regular 11 1 session of the general assembly exceeds one hundred ten 11 2 calendar days and the second regular session exceeds one 11 3 hundred calendar days, the payments shall be made only for one 11 4 hundred ten calendar days for the first session and one 11 5 hundred calendar days for the second session.However,11 6membersMembers from Polk county shall receiveforty-five11 7 sixty-five dollars per day. Each member shall receive aone11 8 two hundredtwenty-fivedollar per month allowance for 11 9 legislative district constituency postage, travel, telephone 11 10 costs, and other expenses. Travel expenses shall be paid at 11 11 the rate established by section 18.117 for actual travel in 11 12 going to and returning from the seat of government by the 11 13 nearest traveled route for not more than one time per week 11 14 during a legislative session.However, any increase from time11 15to time in the mileage rate established by section 18.11711 16shall not become effective for members of the general assembly11 17until the convening of the next general assembly following the11 18session in which the increase is adopted; and this provision11 19shall prevail over any inconsistent provision of any present11 20or future statute.11 21 3. The speaker of the house, presiding officer of the 11 22 senate, and the majority and minority floor leader of each 11 23 house shall each receive an annual salary oftwenty-nine11 24 thirty-one thousand thirty dollars for the year19951997 and 11 25 subsequent years while serving in that capacity. The 11 26 president pro tempore of the senate and the speaker pro 11 27 tempore of the house shall receive an annual salary of 11 28nineteentwenty-one thousandninetwo hundred ninety dollars 11 29 for the year19951997 and subsequent years while serving in 11 30 that capacity. Expense and travel allowances shall be the 11 31 same for the speaker of the house and the presiding officer of 11 32 the senate, the president pro tempore of the senate and the 11 33 speaker pro tempore of the house, and the majority and 11 34 minority leader of each house as provided for other members of 11 35 the general assembly. 12 1 6. In addition to the salaries and expenses authorized by 12 2 this section,membersa member of the general assembly shall 12 3 be paidsixtyeighty-six dollars per day, and necessary travel 12 4 and actual expenses incurred in attending meetings for which 12 5 per diem or expenses are authorized by law for members of the 12 6 general assembly who serve on statutory boards, commissions, 12 7 or councils, and for standing or interim committee or 12 8 subcommittee meetings subject to the provisions of section 12 9 2.14, or when on authorized legislative business when the 12 10 general assembly is not in session. However, if a member of 12 11 the general assembly is engaged in authorized legislative 12 12 business at a location other than at the seat of government 12 13 during the time the general assembly is in session, payment 12 14 may be made for the actual transportation and lodging costs 12 15 incurred because of the business. Such per diem or expenses 12 16 shall be paid promptly from funds appropriated pursuant to 12 17 section 2.12. 12 18 7. If a special session of the general assembly is 12 19 convened, members of the general assembly shall receive, in 12 20 addition to their annual salaries, the sum ofsixtyeighty-six 12 21 dollars per day for each day the general assembly is actually 12 22 in special session, and the same travel allowances and 12 23 expenses as authorized by this section. A member of the 12 24 general assembly shall receive the additional per diem, travel 12 25 allowances and expenses only for the days of attendance during 12 26 a special session. 12 27 Sec. 15. Section 2.40, subsection 1, unnumbered paragraph 12 28 2, Code 1995, is amended to read as follows: 12 29 A member of the general assembly may elect to become a 12 30 member of a state group insurance plan. A member of the 12 31 general assembly may continue membership in a state group 12 32 insurance plan without reapplication during the member's 12 33 tenure as a member of consecutive general assemblies. For the 12 34 purpose of electing to become a member of the state health or 12 35 medical service group insurance plan, a member of the general 13 1 assembly has the status of a "new hire", full-time state 13 2 employee following each election of that member in a general 13 3 or special election, or during the first subsequent annual 13 4 open enrollment. In lieu of membership in a state health or 13 5 medical group insurance plan, a member of the general assembly 13 6 may elect to receive reimbursement for the costs paid by the 13 7 member for a continuation of a group coverage (COBRA) health 13 8 or medical insurance plan. The member shall apply for 13 9 reimbursement by submitting evidence of payment for a COBRA 13 10 health or medical insurance plan. The maximum reimbursement 13 11 shall be no greater than the state's contribution for health 13 12 or medical insurance family plan II. A member of the general 13 13 assembly who elects to become a member of a state health or 13 14 medical group insurance plan shall be exempted from 13 15 preexisting medical condition waiting periods. A member of 13 16 the general assembly may change programs or coverage under the 13 17 state health or medical service group insurance plan during 13 18 the month of January of odd-numbered years, but program and 13 19 coverage change selections shall be subject to the enrollment 13 20 rules established for full-time state employees excluded from 13 21 collective bargaining as provided in chapter 20. A person who 13 22 has been a member of the general assembly for two years and 13 23 who has elected to be a member of a state health or medical 13 24 group insurance plan may continue to be a member of such state 13 25 health or medical group insurance plan by requesting 13 26 continuation in writing to the finance officer within thirty- 13 27 one days after leaving office. The continuing former member 13 28 of the general assembly shall pay the total premium for the 13 29 state plan and shall have the same rights to change programs 13 30 or coverage as state employees. In the event of the death of 13 31 a former member of the general assembly who has elected to 13 32 continue to be a member of a state health or medical group 13 33 insurance plan, the surviving spouse of the former member 13 34 whose insurance would otherwise terminate because of the death 13 35 of the former member may elect to continue to be a member of 14 1 such state health or medical group insurance plan by 14 2 requesting continuation in writing to the finance officer 14 3 within thirty-one days after the death of the former member. 14 4 The surviving spouse of the former member shall pay the total 14 5 premium for the state plan and shall have the same rights to 14 6 change programs or coverage as state employees. 14 7 Sec. 16. Section 7G.1, subsection 8, paragraph a, Code 14 8 1995, is amended to read as follows: 14 9 a. The commission may employ personnel, including an 14 10 executive director whose salary shall not exceed executive 14 11 branch pay grade classification3540, to administer its 14 12 programs and services. The personnel shall be considered 14 13 state employees. 14 14 Sec. 17. EFFECTIVE DATE.
