PAG LIN 1 1 Section 1. Section 8D.3, subsection 3, paragraph i, Code 1 2 1995, is amended to read as follows: 1 3 i. Evaluate existing and projected rates for use of the 1 4 system and ensure that rates are sufficient to pay for the 1 5 operation of the systemexcept to the extent such use is1 6subsidized by general fund appropriations as authorized by the1 7general assemblyexcluding the cost of construction and lease 1 8 costs for Parts I, II, and III. The commission shall 1 9 establish all hourly rates to be charged to all authorized 1 10 users for the use of the network. A fee established by the 1 11 commission to be charged to a hospital licensed pursuant to 1 12 chapter 135B, a physician clinic, or the federal government 1 13 shall be at an appropriate rate so that, at a minimum, there 1 14 is no state subsidy related to the costs of the connection or 1 15 use of the network related to such user. 1 16 Sec. 2. Section 8D.13, Code 1995, is amended by adding the 1 17 following new subsection: 1 18 NEW SUBSECTION. 13B. Access to the network shall not be 1 19 offered or provided to an unauthorized user pursuant to an 1 20 agreement entered into pursuant to chapter 28E between any 1 21 public or private agency and such unauthorized user. 1 22 Sec. 3. There is appropriated from the general fund of the 1 23 state to the Iowa communications network fund created in 1 24 section 8D.14 for the fiscal year beginning July 1, 1994, and 1 25 ending June 30, 1995, the following amount, or so much thereof 1 26 as is necessary: 1 27 .................................................. $ 5,202,234 1 28 Sec. 4. There is appropriated from the general fund of the 1 29 state to the Iowa communications network fund created in 1 30 section 8D.14 for the fiscal year beginning July 1, 1995, and 1 31 ending June 30, 1996, the following amount, or so much thereof 1 32 as is necessary, to be used for the purposes designated: 1 33 1. OPERATIONS 1 34 For salaries, support, maintenance, miscellaneous purposes, 1 35 for the subsidization of video rates for authorized users as 2 1 determined by the commission and consistent with chapter 8D, 2 2 and for not more than the following full-time equivalent 2 3 positions: 2 4 .................................................. $ 4,658,185 2 5 ............................................... NETWORK OPERATIONS REVOLVING FUND 2 7 For a network operations revolving account established in 2 8 the Iowa communications network fund: 2 9 .................................................. $ 1,000,000 2 10 3. STUDY RELATING TO SALE OR CONVERSION OF NETWORK. 2 11 For the coordination and completion of the study relating 2 12 to the sale or conversion of the Iowa communications network 2 13 pursuant to House File 461, if enacted by the general assembly 2 14 during the 1995 regular session, the following amount, or so 2 15 much thereof as is necessary: 2 16 .................................................. $ 250,000 2 17 Sec. 5. There is appropriated from the general fund of the 2 18 state to the public broadcasting division in the department of 2 19 education for the fiscal year beginning July 1, 1995, and 2 20 ending June 30, 1996, the following amount, or so much thereof 2 21 as is necessary, to be used for the purpose designated: 2 22 .................................................. $ 361,420 2 23 Sec. 6. Section 3 of this Act, being deemed of immediate 2 24 importance, takes effect upon enactment. 2 25 Sec. 7. Section 8D.14, Code 1995, is amended to read as 2 26 follows: 2 27 8D.14 IOWA COMMUNICATIONS NETWORK FUND. 2 28 There is created in the office of the treasurer of state a 2 29 fund to be known as the Iowa communications network fund under 2 30 the control of the Iowa telecommunications and technology 2 31 commission.There is appropriated from the general fund of2 32the state to the Iowa communications network fund for each2 33fiscal year of the fiscal period beginning July 1, 1991, and2 34ending June 30, 1996, the sum of five million dollars.There 2 35 shallalsobe deposited into the Iowa communications network 3 1 fund proceeds from bonds issued for purposes of projects 3 2 authorized pursuant to section 8D.13, funds received from 3 3 leases pursuant to section 8D.11, and other moneys by law 3 4 credited to or designated by a person for deposit into the 3 5 fund. 3 6 Sec. 8. There is appropriated from the general fund of the 3 7 state to the Iowa communications network fund under control of 3 8 the Iowa telecommunications and technology commission for the 3 9 fiscal year beginning July 1, 1995, and ending June 30, 1996, 3 10 the following amount, or so much thereof as may be necessary, 3 11 to be used for the purpose designated: 3 12 For debt service: 3 13 .................................................. $ 12,783,000 3 13 MARGINS l 3 14 Upon the appropriation of the funds in this 3 15 section to the Iowa communications network fund, the 3 16 Iowa telecommunications and technology commission 3 17 shall immediately transfer $12,783,000 of the 3 18 appropriated amount to a separate fund established in 3 19 the office of the treasurer of state, to be used 3 20 solely for debt service for the Iowa communications 3 21 network. The commission shall certify to the 3 22 treasurer of state when a debt service payment is due, 3 23 and upon receipt of the certification the treasurer 3 24 shall make the payment.
