1 1 Section 1. NEW SECTION. 100.55 IOWA FIRE SERVICE
1 2 TRAINING AND EQUIPMENT FUND.
1 3 1. An Iowa fire service training and equipment fund is
1 4 created in the office of the treasurer of state. The fund
1 5 consists of all revenues and all other moneys lawfully
1 6 credited or transferred to the fund. The moneys credited to
1 7 the fund may be expended by the division of fire protection in
1 8 the department of public safety for approved training
1 9 activities and equipment by qualified fire departments
1 10 pursuant to rules adopted by the state fire marshal.
1 11 2. For each fiscal year there is appropriated from the
1 12 general fund of the state to the Iowa fire service training
1 13 and equipment fund, the amount of one million dollars.
1 14 3. Section 8.33 does not apply to moneys in the Iowa fire
1 15 service training and equipment fund under this section.
1 16 4. Notwithstanding section 12C.7, interest or earnings on
1 17 investments or time deposits of the moneys in the Iowa fire
1 18 service training and equipment fund shall be credited to the
1 19 Iowa fire service training and equipment fund.
1 20 Sec. 2. NEW SECTION. 100.56 FIRE SERVICE ADVISORY BOARD.
1 21 1. A fire service advisory board is created. The board
1 22 shall be comprised of seven members appointed by the
1 23 commissioner of public safety with special expertise in
1 24 matters pertaining to fire service training and equipment
1 25 needs. The members shall serve for a term of four years. Any
1 26 vacancies on the board shall be filled, for the remainder of
1 27 the term vacated, by appointment by the commissioner.
1 28 2. The advisory board shall advise and confer with the
1 29 state fire marshal in matters relating to the Iowa fire
1 30 service training and equipment fund and shall, at the request
1 31 of the state fire marshal, hold public hearings and perform
1 32 such other functions relating to the fund.
1 33 3. A member may be removed from the board by the
1 34 commissioner for inefficiency, neglect or duty, or misconduct
1 35 or malfeasance of office, after receiving prior written notice
2 1 and an opportunity to be heard.
2 2 4. Each member of the board shall receive per diem
2 3 compensation at the rate specified by section 7E.6, and all
2 4 necessary expenses incurred, while in the performance of their
2 5 duties for the board.
2 6 5. The board shall meet at least once a year and such
2 7 additional times as requested by the state fire marshal. Four
2 8 members of the board shall constitute a quorum.
2 9 6. The state fire marshal shall adopt rules pursuant to
2 10 chapter 17A providing for the administration and distribution
2 11 of the Iowa fire service training and equipment fund. The
2 12 rules shall provide for receiving advice concerning the
2 13 distribution of moneys in the fund from the fire service
2 14 advisory board.
2 15 Sec. 3. TEMPORARY PROVISIONS. Notwithstanding section
2 16 100.56, of the initial appointees to the fire service advisory
2 17 board, three shall be appointed for a two-year term and four
2 18 shall be appointed for a four-year term.
2 19 EXPLANATION
2 20 This bill establishes a fire service training and equipment
2 21 fund within the division of fire protection of the department
2 22 of public safety. The bill provides for a standing
2 23 appropriation of $1 million each fiscal year for the fund.
2 24 The fund is administered by the state fire marshal and moneys
2 25 distributed to qualified fire departments for approved
2 26 training activities and equipment.
2 27 This bill also creates a seven-member fire service advisory
2 28 board appointed by the commissioner of public safety to advise
2 29 the state fire marshal concerning the fire service training
2 30 and equipment fund. The bill provides for the appointment and
2 31 compensation of the members as well as requiring at least
2 32 annual meetings of the board.
