PAG LIN 1 1 Section 1. Section 321.34, subsection 7, Code 1995, is 1 2 amended to read as follows: 1 3 7. HANDICAPPED PLATES. The owner of a motor vehicle 1 4 subject to registration pursuant to section 321.109, 1 5 subsection 1, light delivery truck, panel delivery truck, or 1 6 pickup, who is a handicapped person, or who is the parent or1 7guardian of a child who resides with the parent or guardian1 8owner and who is a handicapped person, as defined in section1 9321L.1,may, upon written application to the department, order 1 10 handicapped registration plates designed by the department 1 11 bearing the international symbol of accessibility, if the 1 12 owner is a handicapped person or a parent or guardian of a 1 13 child who resides with the parent or guardian owner and is a 1 14 handicapped person, as defined in section 321L.1, or if a 1 15 person authorized by the owner to operate the vehicle is a 1 16 handicapped person and uses the vehicle as the authorized 1 17 user's principal means of transportation. The handicapped 1 18 registration plates shall only be issued if the application is 1 19 accompanied with a statement from a physician licensed under 1 20 chapter 148, 149, 150, or 150A, or a chiropractor licensed 1 21 under chapter 151, written on the physician's or 1 22 chiropractor's stationery, stating the nature of the 1 23 applicant's,orthe applicant's child's, or the authorized 1 24 user's handicap and such additional information as required by 1 25 rules adopted by the department, including proof of residency 1 26 of a child or authorized user of the motor vehicle who is a 1 27 handicapped person. If the application is approved by the 1 28 department the handicapped registration plates shall be issued 1 29 to the applicant in exchange for the previous registration 1 30 plates issued to the person. The fee for the handicapped 1 31 plates is five dollars which is in addition to the regular 1 32 annual registration fee. The department shall validate the 1 33 handicapped plates in the same manner as regular registration 1 34 plates are validated under this section at the regular annual 1 35 registration fee. However, the handicapped plates shall not 2 1 be renewed without the applicant furnishing evidence to the 2 2 department that the owner of the motor vehicle, the authorized 2 3 user of the motor vehicle, or the owner's child is still a 2 4 handicapped person as defined in section 321L.1, unless the 2 5 applicant has previously provided satisfactory evidence to the 2 6 department that the owner of the vehicle, the authorized user 2 7 of the motor vehicle, or the owner's child is permanently 2 8 handicapped in which case the furnishing of additional 2 9 evidence shall not be required for renewal. However, an owner 2 10 who has a child who is a handicapped person shall provide 2 11 satisfactory evidence to the department that the handicapped 2 12 child continues to reside with the owner. The handicapped 2 13 registration plates shall be surrendered in exchange for 2 14 regular registration plates when the owner of the motor 2 15 vehicle, the authorized user of the motor vehicle, or the 2 16 owner's child no longer qualifies as a handicapped person as 2 17 defined in section 321L.1 or when the owner's child who is a 2 18 handicapped person no longer resides with the owner. 2 19 EXPLANATION 2 20 This bill permits an owner of a vehicle subject to 2 21 registration to obtain handicapped plates so long as an 2 22 authorized user of the vehicle is handicapped and uses the 2 23 vehicle as the authorized user's primary means of 2 24 transportation. 2 25 LSB 2488HH 76 2 26 ec/sc/14
