  1  1    Section 1.  PERSONAL ASSISTANCE SERVICES.
  1  2    1.  The department of human services, in consultation with
  1  3 the personal assistance and family support services council
  1  4 created in section 225C.48, shall submit a request to the
  1  5 United States department of health and human services to amend
  1  6 the mental retardation and the ill and handicapped home and
  1  7 community-based services waivers to include the provision of
  1  8 consumer-directed attendant care as a fundable service under
  1  9 the medical assistance home and community-based services
  1 10 waiver.  If approved, the consumer-directed attendant care
  1 11 services portion of the waiver as provided in 1994 Iowa Acts,
  1 12 chapter 1041, section 5, shall be implemented immediately
  1 13 following approval.
  1 14    2.  The department of human services, in consultation with
  1 15 the personal assistance and family support services council
  1 16 created in section 225C.48, shall submit a waiver request to
  1 17 the United States department of health and human services for
  1 18 approval of funding of services provided to persons with
  1 19 physical disabilities through the medical assistance home and
  1 20 community-based services waiver, including consumer-directed
  1 21 attendant care services.  If approved, the services, as
  1 22 provided in 1994 Iowa Acts, chapter 1041, section 5, shall be
  1 23 implemented immmediately following approval.  The department
  1 24 shall use existing state funds to draw down federal funds for
  1 25 the consumer-directed attendant services.  The department
  1 26 shall not propose or implement the medical assistance home and
  1 27 community-based waiver for services for persons with physical
  1 28 disabilities in a manner which would require county funding to
  1 29 match federal funding.  The nonfederal funding match shall be
  1 30 provided only through expenditure of state funds from existing
  1 31 human services programs, including but not limited to the in-
  1 32 home-health-related program and other programs which are
  1 33 funded solely through expenditure of state funds.
  1 34    Sec.2.  PERSONAL ASSISTANCE SERVICES &endash; APPROPRIATION.
  1 35    There is appropriated from the general fund of the state to
  2  1 the department of human services for the fiscal year beginning
  2  2 July 1, 1995, and ending June 30, 1996, the following amount,
  2  3 or so much thereof as is necessary, to be used for the purpose
  2  4 designated:
  2  5    For the personal assistance services program created in
  2  6 section 225C.46:  
  2  7 .................................................. $  2,889,723
  2  8    Sec.3.  EFFECTIVE DATE.  This Act, being deemed of
  2  9 immediate importance, takes effect upon enactment.  
  2 10                           EXPLANATION
  2 11    This bill directs the department of human services to
  2 12 submit a request to the United States department of health and
  2 13 human services to amend the medical assistance home and
  2 14 community-based waivers for persons with mental retardation
  2 15 and for the ill and handicapped, to include consumer-directed
  2 16 attendant care as a fundable service for both of these
  2 17 populations.  The services are to be implemented immediately
  2 18 following approval of the waiver.
  2 19    The bill also directs the department of human services to
  2 20 submit a request to the United States department of health and
  2 21 human services to amend the medical assistance home and
  2 22 community-based services waiver to include services to persons
  2 23 with physical disabilities to include the provision of
  2 24 consumer-directed attendant care services.  The waiver is to
  2 25 be implemented immediately following approval and only if
  2 26 existing state funding, not county funding, is used to provide
  2 27 a match for federal funding.
  2 28    The bill also makes an appropriation from the general fund
  2 29 of the state of the department of human services for personal
  2 30 assistance services program in the amount of $2,889,723.
  2 31    The bill takes effect upon enactment.
