PAG LIN 1 1 Section 1. Section 513B.2, subsection 9, Code 1995, is 1 2 amended to read as follows: 1 3 9. "Eligible employee" means an employee who works on a 1 4 full-time basis and has a normal work week of thirty or more 1 5 hours. The term includes a sole proprietor, a partner of a1 6partnership,and an independent contractor, if the sole 1 7 proprietor, partner,or independent contractor is included as 1 8 an employee under a health benefit plan of a small employer, 1 9 but does not include an employee who works on a part-time, 1 10 temporary, or substitute basis. 1 11 "Eligible employee" also includes a partner of a partner- 1 12 ship if the partner is included as an employee under a health 1 13 benefit plan of the small employer and works on a full-time 1 14 basis and has a normal work week of thirty or more hours or 1 15 has a normal work week of less than thirty hours a week but is 1 16 actively involved in the partnership. 1 17 EXPLANATION 1 18 This bill amends the definition of "eligible employee" for 1 19 purposes of small group health benefit plans to include a 1 20 partner in the small business who has a normal work week of 1 21 less than 30 hours a week but is actively involved in the 1 22 partnership.
