  1  1    Section 1.  Section 161C.1, Code 1995, is amended by adding
  1  2 the following new subsection before subsection 1 and
  1  3 renumbering subsequent subsections:
  1  4    NEW SUBSECTION.  1.  "Animal feeding operation" means a
  1  5 lot, yard, corral, building, or other area in which animals
  1  6 are confined and fed and maintained for forty-five days or
  1  7 more in any twelve-month period, and all structures used for
  1  8 the storage of manure from animals in the operation.
  1  9    Sec. 2.  Section 161C.1, Code 1995, is amended by adding
  1 10 the following new subsection:
  1 11    NEW SUBSECTION.  1A.  "Confinement feeding operation" means
  1 12 an animal feeding operation in which animals are confined to
  1 13 areas which are totally roofed.
  1 14    Sec. 3.  Section 161C.5, subsection 3, Code 1995, is
  1 15 amended to read as follows:
  1 16    3.  The fund shall be used to support the organic nutrient
  1 17 management program provided in section 161C.6.  Moneys shall
  1 18 be used to provide financial incentives under the program and
  1 19 to pay for expenses incurred by the division in administering
  1 20 the program.  Not less than five percent of the moneys in the
  1 21 fund shall be expended for purposes of supporting tree
  1 22 planting projects as provided in section 161C.6.  Not more
  1 23 than two percent of the moneys shall be used to pay for
  1 24 administering the program.  Moneys expended for financial
  1 25 incentives shall be allocated on a cost-share basis.  The
  1 26 division may adopt rules to administer this section.
  1 27    Sec. 4.  Section 161C.6, subsection 2, paragraph a, Code
  1 28 1995, is amended to read as follows:
  1 29    a.  The program shall provide financial incentives to
  1 30 establish livestock manure management systems to facilitate
  1 31 the proper utilization of livestock manure as a nutrient
  1 32 source, and to protect the water resources of the state from
  1 33 livestock manure runoff.  Each fiscal year beginning on July 1
  1 34 and ending on June 30, the division shall provide financial
  1 35 incentives to support projects which reduce odor resulting
  2  1 from animal feeding operations, especially confinement feeding
  2  2 operations.  The division shall establish a tree planting
  2  3 project to support the planting of fast-growing trees
  2  4 surrounding operations, including manure storage structures
  2  5 used as part of the operations.  During each fiscal year, the
  2  6 division shall provide financial incentives to facilitate the
  2  7 proper utilization of livestock manure as a nutrient source,
  2  8 and to protect the water resources of the state from livestock
  2  9 manure runoff.  
  2 10                           EXPLANATION
  2 11    This bill amends chapter 161C, which, in part, establishes
  2 12 an organic nutrient management program which is supported by
  2 13 an organic nutrient management fund.  The program is
  2 14 administered by the soil conservation division of the
  2 15 department of agriculture and land stewardship.  The purpose
  2 16 of the program is to provide financial incentives on a cost-
  2 17 share basis with eligible persons, to establish livestock
  2 18 manure management systems to facilitate the proper utilization
  2 19 of livestock manure as a nutrient source, and to protect the
  2 20 water resources of the state from livestock manure runoff.  A
  2 21 person is eligible to participate in the program, if the
  2 22 person is a livestock producer who is an individual or family
  2 23 farm entity recognized by the corporate farming law (chapter
  2 24 9H).
  2 25    This bill provides that projects eligible to be supported
  2 26 by the fund include projects which reduce odor resulting from
  2 27 animal feeding operations, especially confinement feeding
  2 28 operations.  The bill also provides that the division must use
  2 29 5 percent of moneys in the fund to support the planting of
  2 30 fast-growing trees surrounding operations, including manure
  2 31 storage structures used as part of the operations.
