  1  1    Section 1.  DIVISION OF VOCATIONAL REHABILITATION &endash; CEN-
  1  2 TERS FOR INDEPENDENT LIVING.  There is appropriated from the
  1  3 general fund of the state to the department of education for
  1  4 the fiscal year beginning July 1, 1995, and ending June 30,
  1  5 1996, the following amount, or so much thereof as is neces-
  1  6 sary, to be used for the purpose designated:
  1  7    For grants administered by the division of vocational re-
  1  8 habilitation, in accordance with the provisions of this
  1  9 section:  
  1 10 .................................................. $    876,000
  1 11    1.  The general assembly finds that independent living
  1 12 centers enable persons with disabilities to access independent
  1 13 living skills training, peer counseling, information and
  1 14 referral services, and individual and system advocacy
  1 15 activities, and that access to these resources is essential
  1 16 for persons with disabilities to realize their rights and
  1 17 responsibilities as citizens.
  1 18    2.  The division of vocational rehabilitation shall dis-
  1 19 tribute the moneys appropriated in this section through grants
  1 20 to independent living centers in accordance with a plan
  1 21 developed in cooperation with the statewide independent living
  1 22 council.  Grants shall be limited to independent living
  1 23 centers located in this state which receive or are eligible to
  1 24 receive a federal grant to centers for independent living
  1 25 under 29 U.S.C. } 796f et seq.  Moneys granted under this
  1 26 section shall be used in accordance with federal requirements
  1 27 for centers for independent living.  A grantee providing
  1 28 independent living services in this and another state shall
  1 29 utilize moneys granted under this section only for assistance
  1 30 provided to residents of this state.  Moneys shall be
  1 31 distributed in a manner so as to ensure that the combination
  1 32 of federal and state funds provided in a fiscal year to the
  1 33 independent living centers located in this state for
  1 34 independent living resources is at least $225,000.  The
  1 35 division shall establish reporting requirements and other
  2  1 requirements deemed necessary by the division to ensure that
  2  2 the moneys granted under this section are used appropriately.
  2  3    3.  Of the moneys appropriated in this section, not more
  2  4 than $250,000 shall be used for funding of independent living
  2  5 centers in areas of the state which are unserved or
  2  6 underserved by an independent living center as of June 30,
  2  7 1995.  
  2  8                           EXPLANATION
  2  9    This bill relates to and makes an appropriation to the de-
  2 10 partment of education for grants to centers for independent
  2 11 living for persons with disabilities.  The grants are to be
  2 12 administered by the department's division of vocational reha-
  2 13 bilitation in accordance with a plan developed cooperatively
  2 14 with the statewide independent living council.  The statewide
  2 15 independent living council is an entity created in accordance
  2 16 with federal law.
  2 17    Definitions and other requirements for centers for
  2 18 independent living are established in federal law.  The
  2 19 requirements include nonprofit status, a focus on serving
  2 20 persons with severe disabilities, control of the center by
  2 21 persons with disabilities, provision of certain core services,
  2 22 an emphasis on community-based, nonresidential services, and
  2 23 provision for equal access to services.
  2 24    The division is directed to distribute moneys in a manner
  2 25 to ensure a minimum funding level for the centers for indepen-
  2 26 dent living and to develop reporting and other requirements to
  2 27 ensure moneys are used appropriately.
