  1  1    Section 1.  Section 262.2, Code 1995, is amended to read as
  1  2 follows:
  1  3    262.2  APPOINTMENT &endash; TERM OF OFFICE.
  1  4    1.  The members shall be appointed by the governor subject
  1  5 to confirmation by the senate.  The term of each member of the
  1  6 board shall be for six years, except the term of the ninth
  1  7 member shall be for four years.  If the ninth member graduates
  1  8 before the end of the two-year term, the ninth member may
  1  9 remain on the board until the term expires if the member's
  1 10 graduation is within one year of the date of the expiration.
  1 11 The terms of three members of the board shall begin and expire
  1 12 in each odd-numbered year as provided in section 69.19.
  1 13    2.  The recognized student government organization at each
  1 14 of the three institutions of higher learning under the control
  1 15 of the board shall submit, at least biennially, to the
  1 16 executive director who shall transfer to the governor a list
  1 17 of at least three names of students eligible to represent the
  1 18 institution on the board.  The governor may appoint the ninth
  1 19 member of the board from the lists of names submitted by the
  1 20 recognized student organizations.
  1 21    Sec. 2.  Section 262.6, Code 1995, is amended to read as
  1 22 follows:
  1 23    262.6  VACANCIES.
  1 24    Vacancies shall be filled in the same manner in which
  1 25 regular appointments are required to be as original
  1 26 appointments are made and shall be for the remainder of the
  1 27 unexpired term of the vacancy.  If the ninth member resigns
  1 28 prior to the expiration of the term, the individual appointed
  1 29 to fill the vacancy shall meet the requirements for the ninth
  1 30 member specified in section sections 262.1 and 262.2.  Other
  1 31 vacancies occurring prior to the expiration of the ninth
  1 32 member's term shall be filled in the same manner as the
  1 33 original appointments for those vacancies.
  1 34    Sec. 3.  IMPLEMENTATION AND TRANSITION PROVISION.  In order
  1 35 to implement this Act and provide for the transition of the
  2  1 reduction in the term of service of the ninth member of the
  2  2 state board of regents, notwithstanding any provision of this
  2  3 Act to the contrary, the term of the ninth member serving on
  2  4 the board on the effective date of this Act shall continue
  2  5 until the term expires on April 30, 1997, and the governor may
  2  6 appoint a ninth member from the lists of names provided to the
  2  7 executive director by the recognized student organization of
  2  8 each of the institutions of higher learning for the four-year
  2  9 term of the ninth member commencing May 1, 1997.
