  1  1    Section 1.  Section 261C.6, unnumbered paragraph 1, Code
  1  2 1995, is amended to read as follows:
  1  3    Not later than June 30 of each year, a An eligible student
  1  4 who has successfully completed and received credit for a
  1  5 course taken at an eligible postsecondary institution may make
  1  6 application to the school district of residence for tuition
  1  7 reimbursement not later than June 15 of the school year in
  1  8 which the postsecondary course credit was received.  A school
  1  9 district shall may pay a tuition reimbursement amount to an
  1 10 eligible postsecondary institution that has enrolled its
  1 11 resident eligible pupils the parent, guardian, or legal
  1 12 custodian under this chapter.  However, if the household
  1 13 income of the parent, guardian, or legal custodian of the
  1 14 eligible student who enrolls in an eligible postsecondary
  1 15 institution under this chapter is at or below one hundred
  1 16 sixty percent of the federal poverty guidelines as published
  1 17 by the United States department of agriculture, the student is
  1 18 not responsible for costs directly related to the course, and
  1 19 the school district shall pay a tuition reimbursement amount
  1 20 not later than June 30 to the eligible postsecondary
  1 21 institution if the student successfully completed and received
  1 22 credit for a course taken under the provisions of this
  1 23 chapter.  For pupils In addition, for students enrolled at the
  1 24 school for the deaf and the Iowa braille and sight saving
  1 25 school, the state board of regents shall pay a tuition
  1 26 reimbursement amount to the eligible institution by June 30 of
  1 27 each year.
  1 28    Except as otherwise provided in this section, the student
  1 29 is responsible for all costs directly related to the course if
  1 30 the student fails to complete and receive credit for the
  1 31 course taken under the provisions of this chapter.  If the
  1 32 administrator of the area education agency verifies that the
  1 33 student qualifying on the basis of the federal poverty
  1 34 guidelines specified in this section was unable to complete
  1 35 the course for reasons including but not limited to the
  2  1 student's physical incapacity, death in the family, or the
  2  2 student's move to another school district, a verification by
  2  3 the administrator of the area education agency shall
  2  4 constitute a waiver to the requirement that the student,
  2  5 student's parent, guardian, or legal custodian pay the costs
  2  6 of the course.
  2  7    PARAGRAPH DIVIDED.  The amount of tuition reimbursement for
  2  8 each separate course shall equal the lesser of:
  2  9    Sec. 2.  Section 261C.8, Code 1995, is amended to read as
  2 10 follows:
  2 11    261C.8  PROHIBITION ON CHARGES.
  2 12    An If the household income of the parent, guardian, or
  2 13 legal custodian of the student who enrolls in an eligible
  2 14 postsecondary institution under this chapter is at or below
  2 15 one hundred sixty percent of the federal poverty guidelines as
  2 16 published by the United States department of agriculture, an
  2 17 eligible postsecondary institution that enrolls an eligible
  2 18 pupil student under this chapter shall not charge that pupil
  2 19 student for tuition, textbooks, materials, or fees directly
  2 20 related to the course in which the pupil student is enrolled
  2 21 except that the pupil student may be required to purchase
  2 22 equipment that becomes the property of the pupil student.
  2 23 However, if the pupil a student qualifying on the basis of the
  2 24 federal poverty guidelines specified in this section fails to
  2 25 complete and receive credit for the course, the pupil student,
  2 26 or if the student is under eighteen years of age, the
  2 27 student's parent, guardian, or legal custodian, is responsible
  2 28 for all costs directly related to the course as provided in
  2 29 section 261C.6 and shall reimburse the school district for its
  2 30 costs.  If the pupil is under eighteen years of age, the
  2 31 pupil's parent, guardian, or custodian shall sign the student
  2 32 registration form indicating that the parent, guardian, or
  2 33 custodian is responsible for all costs directly related to the
  2 34 course, if the pupil fails to complete and receive credit for
  2 35 the course.
  3  1    If the local area education agency verifies that the pupil
  3  2 was unable to complete the course for reasons including but
  3  3 not limited to the pupil's physical incapacity, death in the
  3  4 family, or the pupil's move to another school district, a
  3  5 verification by the area education agency shall constitute a
  3  6 waiver to the requirement that the pupil, pupil's parent,
  3  7 guardian, or legal custodian pay the costs of the course to
  3  8 the school district.  
  3  9                           EXPLANATION
  3 10    This bill makes optional a current Code requirement that a
  3 11 school district must pay a tuition reimbursement for an
  3 12 eligible student who has successfully completed and received
  3 13 credit for a course taken at an eligible postsecondary
  3 14 institution.  However, it requires the school district to pay
  3 15 if the household income of the student's parent, guardian, or
  3 16 legal custodian is at or below 160 percent of the federal
  3 17 poverty guidelines.
  3 18    If the student fails to complete and receive credit for the
  3 19 course, the student is responsible for all costs directly
  3 20 related to the course.  If the student is under 18 years of
  3 21 age, the student's parent, guardian, or custodian shall sign
  3 22 the student registration form indicating that the parent,
  3 23 guardian, or custodian is responsible for all costs directly
  3 24 related to the course if the student fails to complete and
  3 25 receive credit for the course.  If the local area education
  3 26 agency verifies that a low-income student was unable to
  3 27 complete the course for reasons including but not limited to
  3 28 the student's physical incapacity, death in the family, or the
  3 29 student's move to another school district, a verification by
  3 30 the area education agency shall constitute a waiver to the
  3 31 requirement that the student, student's parent, guardian, or
  3 32 legal custodian pay the costs of the course.
  3 33    Also, if the household income of the student's parent,
  3 34 guardian, or legal custodian is at or below 160 percent of the
  3 35 federal poverty guidelines, an eligible postsecondary
  4  1 institution that enrolls an eligible student shall not charge
  4  2 that student for tuition, textbooks, materials, or fees
  4  3 directly related to the course in which the student is
  4  4 enrolled except that the student may be required to purchase
  4  5 equipment that becomes the property of the student.
