  1  1    Section 1.  Section 262.1, Code 1995, is amended to read as
  1  2 follows:
  1  3    262.1  MEMBERSHIP.
  1  4    The state board of regents consists of nine eleven members,
  1  5 eight of whom shall be selected from the state at large solely
  1  6 with regard to their qualifications and fitness to discharge
  1  7 the duties of the office.  The ninth member Three members
  1  8 shall be a student students enrolled on a full-time basis in
  1  9 good standing at either the graduate or undergraduate level at
  1 10 one of the institutions listed in section 262.7, subsection 1,
  1 11 2, or 3, at the time of the member's appointment.  Not more
  1 12 than five six members shall be of the same political party.
  1 13    Sec. 2.  Section 262.2, Code 1995, is amended to read as
  1 14 follows:
  1 15    262.2  APPOINTMENT &endash; TERM OF OFFICE.
  1 16    1.  The members shall be appointed by the governor subject
  1 17 to confirmation by the senate.  The term of each member of the
  1 18 board shall be for six years.  Nonstudent members shall serve
  1 19 six-year terms and student members shall serve two-year terms.
  1 20 The terms of two or three nonstudent members and the term of
  1 21 one student member of the board shall begin and expire in each
  1 22 odd-numbered year, and the terms of two student members shall
  1 23 begin and expire in each even-numbered year, as provided in
  1 24 section 69.19.
  1 25    2.  The recognized student government organization at each
  1 26 of the three institutions of higher learning under the control
  1 27 of the board shall submit, at least biennially, to the
  1 28 governor a list of at least three names of students eligible
  1 29 to represent the institution on the board.  From the lists of
  1 30 names submitted by the organizations, the governor shall
  1 31 appoint one student from each of the institutions of higher
  1 32 learning under the control of the board to serve as a board
  1 33 member.  A student member may remain on the board until the
  1 34 expiration of the student's term if the student member
  1 35 graduates within one year of the date of the expiration.
  2  1    Sec. 3.  Section 262.6, Code 1995, is amended to read as
  2  2 follows:
  2  3    262.6  VACANCIES.
  2  4    Vacancies shall be filled in the same manner in which
  2  5 regular appointments are required to be as original
  2  6 appointments are made and shall be for the remainder of the
  2  7 unexpired term of the vacancy.  If the ninth a student member
  2  8 resigns prior to the expiration of the student's term, the
  2  9 individual appointed to fill the vacancy shall meet the
  2 10 requirements for the ninth member student membership specified
  2 11 in section sections 262.1 and 262.2.  Other vacancies
  2 12 occurring prior to the expiration of the ninth member's term
  2 13 shall be filled in the same manner as the original
  2 14 appointments for those vacancies.
  2 15    Sec. 4.  IMPLEMENTATION AND TRANSITION PROVISIONS.  In
  2 16 order to implement this Act and provide for the transition of
  2 17 the terms of service and membership of the state board of
  2 18 regents as required by this Act, notwithstanding any provision
  2 19 of this Act to the contrary, the terms of the student members
  2 20 of the board shall be implemented as follows:
  2 21    1.  The term of the student member serving on the board on
  2 22 the effective date of this Act shall continue until the term
  2 23 expires on April 30, 1997, and the governor shall appoint a
  2 24 student member from the list of names provided representing
  2 25 the same institution of higher learning for the two-year term
  2 26 of the student member which commences May 1, 1997.
  2 27    2.  The two-year terms of the two student members added to
  2 28 the board in accordance with this Act representing the two
  2 29 institutions of higher learning that are not represented
  2 30 pursuant to subsection 1 shall commence on May 1, 1996.  
  2 31                           EXPLANATION
  2 32    This bill increases membership on the state board of
  2 33 regents from eight to 11 members by adding two more student
  2 34 members to the board so that each institution of higher
  2 35 learning under the control of the board has a student
  3  1 representative as a member of the board.  Under the bill, the
  3  2 recognized student government organization at each of the
  3  3 institutions of higher learning under the control of the board
  3  4 shall submit, at least biennially, to the governor a list of
  3  5 at least three names of eligible students.
  3  6    From the names submitted, the governor is to appoint one
  3  7 student from each of the three institutions to serve as a
  3  8 board member.  Nonstudent members will continue to serve a
  3  9 six-year term under the bill, but the student members' terms
  3 10 are reduced to two years.  If a student member graduates
  3 11 before expiration of the two-year term, the bill provides that
  3 12 the student member may remain on the board if the student's
  3 13 graduation is within one year of the date of the expiration of
  3 14 the student's term on the board.
  3 15    Implementation and transition provisions included in the
  3 16 bill permit the current student member on the board to finish
  3 17 the current term, which expires April 30, 1997.  The student
  3 18 members appointed from lists submitted to the governor by the
  3 19 recognized student government organizations at the other two
  3 20 institutions of higher learning shall serve two-year terms
  3 21 commencing May 1, 1996.
