  1  1    Section 1.  Section 216.19, unnumbered paragraph 3, Code
  1  2 1995, is amended to read as follows:
  1  3    An agency or commission of local government and the Iowa
  1  4 civil rights commission shall co-operate in the sharing of
  1  5 data and research, and co-ordinating investigations and
  1  6 conciliations in order to expedite claims of unlawful
  1  7 discrimination and eliminate needless duplication.  A city
  1  8 with a population of twenty-nine fifty thousand, or greater,
  1  9 shall maintain an independent local civil rights agency or
  1 10 commission consistent with commission rules adopted pursuant
  1 11 to chapter 17A.  A city with a population of less than fifty
  1 12 thousand which has an independent civil rights agency or
  1 13 commission as of July 1, 1995, shall continue to maintain its
  1 14 civil rights commission or agency.  An agency or commission
  1 15 for which a staff is provided shall have control over such
  1 16 staff.  A city required to maintain a local civil rights
  1 17 agency or commission shall structure and adequately fund the
  1 18 agency or commission in order to effect cooperative
  1 19 undertakings with the Iowa civil rights commission and to aid
  1 20 in effectuating the purposes of this chapter.  The Iowa civil
  1 21 rights commission may enter into cooperative agreements with
  1 22 any local agency or commission to effectuate the purposes of
  1 23 this chapter.  Such agreements may include technical and
  1 24 clerical assistance and reimbursement of expenses incurred by
  1 25 the local agency or commission in the performance of the
  1 26 agency's or commission's duties if funds for this purpose are
  1 27 appropriated by the general assembly.  
  1 28                           EXPLANATION
  1 29    This bill changes the size of a city required to establish
  1 30 an independent civil rights agency from a population of 29,000
  1 31 to 50,000.  Any city of less than 50,000 population that has
  1 32 an independent human rights agency as of July 1, 1995, is
  1 33 required to maintain its agency.
