PAG LIN 1 1 Section 1. NEW SECTION. 17A.34 REVIEW OF RULES BY 1 2 AGENCIES. 1 3 1. At least once a year, each agency shall review all of 1 4 its rules to determine whether any new rule should be adopted, 1 5 or an existing rule amended or repealed. In conducting the 1 6 review, each agency shall prepare a written report summarizing 1 7 its findings, supporting reasons, and any proposed course of 1 8 action. For each rule, the report must include, at least once 1 9 every seven years, a concise statement of all the following: 1 10 a. The rule's effectiveness in achieving its objectives, 1 11 including a summary of any available data supporting the 1 12 agency's conclusions. 1 13 b. Criticisms of the rule received during the previous 1 14 seven years, including a summary of any petition received by 1 15 the department, relating to the amendment or repeal of the 1 16 rule, as provided in section 17A.7. 1 17 c. Alternative solutions to the criticisms of the rule, 1 18 reasons alternative solutions were rejected, or changes made 1 19 in the rule in response to the criticisms and the reasons for 1 20 the changes. 1 21 2. An agency shall submit a copy of the report to the 1 22 administrative rules review committee as provided by the 1 23 committee. The Iowa administrative code editor may publish 1 24 the dates for each agency's submission of a report in the Iowa 1 25 administrative bulletin or the Iowa administrative code. 1 26 EXPLANATION 1 27 This bill amends chapter 17A by providing for the periodic 1 28 review of agency rules by the agencies. The bill provides 1 29 that at least once each year, agencies must review all of 1 30 their rules to determine whether new rules should be adopted, 1 31 or existing rules should be amended or repealed. In 1 32 conducting that review, each agency must prepare a written 1 33 report summarizing its findings, supporting reasons, and any 1 34 proposed course of action. For each rule, the report must 1 35 include, at least once every seven years, a concise statement 2 1 describing the effectiveness of the rule, criticisms of the 2 2 rule, and the agency's response to the criticisms.
