1 1 Section 1. NEW SECTION. 321A.40 TEMPORARY RESTRICTED
1 2 LICENSE.
1 3 Notwithstanding other provisions of this chapter, a person
1 4 whose motor vehicle license has been suspended for failure to
1 5 provide adequate financial security under section 321A.5 or
1 6 for nonpayment of judgment under section 321A.13 may apply to
1 7 the department for a temporary restricted license. A
1 8 temporary restricted license may only be issued by the
1 9 department if it is necessary for the person to maintain the
1 10 person's present employment. A temporary restricted license
1 11 shall be valid until such time as the person satisfies the
1 12 requirements of this chapter.
1 13 EXPLANATION
1 14 Current law provides that a person who was involved in an
1 15 accident which resulted in bodily injury or death or damage to
1 16 property of any one person in excess of $500 shall have the
1 17 person's license and registration suspended if the person does
1 18 not have motor vehicle liability insurance and does not
1 19 provide security in an amount sufficient to satisfy any
1 20 judgment for damages resulting from the accident. Current law
1 21 also requires suspension for nonpayment of a judgment within
1 22 60 days.
1 23 This bill allows for a temporary restricted license to be
1 24 issued to a person whose license has been suspended under
1 25 chapter 321A. The license may only be issued by the state
1 26 department of transportation if the temporary restricted
1 27 license is necessary for the person to maintain the person's
1 28 present employment. A temporary restricted license shall be
1 29 valid until the person satisfies the financial responsibility
1 30 requirements of chapter 321A.
