1 1 Section 1. Section 321.445, Code 1995, is amended by
1 2 adding the following new subsection:
1 3 NEW SUBSECTION. 6. A person under the age of eighteen
1 4 shall not ride, and an operator shall not permit a person
1 5 under the age of eighteen to ride, in the open bed of a motor
1 6 truck or in an unenclosed area of a motor vehicle on a highway
1 7 unless the person is properly seated on a seat and wearing a
1 8 properly adjusted and fastened seat belt or safety harness
1 9 which meets the requirements of subsection 1. This section
1 10 does not apply to a motor vehicle operated as part of a
1 11 parade, a motorcycle or moped, a military motor vehicle, an
1 12 authorized emergency vehicle, an implement of husbandry, or a
1 13 motor vehicle used to transport hunters and hunting dogs
1 14 during hunting activities.
1 15 EXPLANATION
1 16 This bill prohibits a person under the age of 18 from
1 17 riding in the open bed of a truck, i.e., the back of a pickup,
1 18 without being properly seated and wearing a seat belt. The
1 19 bill does not apply to persons under the age of 18 who are
1 20 participating in a parade, motorcycles or mopeds, a military
1 21 motor vehicle, an authorized emergency vehicle, an implement
1 22 of husbandry, or a vehicle used for hunting. A violation is
1 23 punishable as a simple misdemeanor and carries a scheduled
1 24 fine of $10.
