PAG LIN 1 1 Section 1. Section 321.1, subsection 39, paragraph b, Code 1 2 1995, is amended to read as follows: 1 3 b. "Travel trailer" means a vehicle without motive power 1 4 used,or somanufactured, or constructedasto permit its 1 5being useduse as a conveyance upon the public streets and 1 6 highways andsodesigned to permitthe vehicle to be usedits 1 7 use as a place of human habitation by one or more persons. 1 8SaidThe vehicle may be up to eight feet six inches in width 1 9 and its overall length shall not exceed forty feet.SuchThe 1 10 vehicle shall be customarily or ordinarily used for vacation 1 11 or recreational purposes and not used as a place of permanent 1 12 habitation. Ifany suchthe vehicle is used in this state as 1 13 a place of human habitation for more than ninety consecutive 1 14 days in one location it shall be classed as a mobile home 1 15 regardless of the size limitationshereinprovided in this 1 16 paragraph. 1 17 EXPLANATION 1 18 This bill conforms the statutory definition of travel 1 19 trailer to the statutorily authorized width for travel 1 20 trailers and certain other vehicles which is eight feet six 1 21 inches. Section 321.454 was amended in 1994 to provide that 1 22 travel trailers having a total outside width not exceeding 1 23 eight feet six inches are exempt from excessive size and 1 24 weight permitting requirements of chapter 321E and may be 1 25 operated on the roads of the state; however, the definition of 1 26 travel trailer in section 321.1 was not amended. 1 27 LSB 1760HV 76 1 28 js/cf/24
