  1  1    Section 1.  NEW SECTION.  257.51  EXTENDED SCHOOL YEAR
  1  2 PROGRAM.
  1  3    1.  An extended school year program is established for
  1  4 school districts to provide additional days during a school
  1  5 year for students, in-service training for licensed
  1  6 practitioners who are employees of the school district, or
  1  7 both.  The extended school year consists of a time period not
  1  8 exceeding thirty additional school or work days beyond the one
  1  9 hundred eighty days of a school year required under section
  1 10 279.10.  An extended school year is not a year around school
  1 11 under section 256.20 or an innovative school year under
  1 12 section 279.10, subsection 3.  A board of directors of a
  1 13 school district that wishes to consider participating in an
  1 14 extended school year program for a period not exceeding five
  1 15 years shall hold a public hearing on the question of
  1 16 participation.  The board shall set forth in a resolution the
  1 17 purposes for which the additional days will be used, which may
  1 18 include the provision of remedial work in specific classes or
  1 19 grades, enrichment activities in specific classes or grades,
  1 20 or professional development or in-service activities for
  1 21 licensed practitioners employed by the district, or all of
  1 22 these; and the proposed budget for the program for the first
  1 23 fiscal year, including the estimated extended school year
  1 24 levy, and the estimated extended school year state aid that
  1 25 will fund the program; and shall publish the notice of the
  1 26 time and place of the public hearing on the resolution.
  1 27    Notice of the time and place of the public hearing shall be
  1 28 published in one or more newspapers not less than ten nor more
  1 29 than twenty days before the public hearing.  For the purpose
  1 30 of establishing and giving assured circulation to the
  1 31 proceedings, only a newspaper which is a newspaper of general
  1 32 circulation issued at a regular frequency, distributed in the
  1 33 school district's geographic area, and regularly delivered or
  1 34 mailed through the post office during the preceding two years
  1 35 may be used for the publication.  In addition, the newspaper
  2  1 must have a list of subscribers who have paid, or promised to
  2  2 pay, at more than a nominal rate, for copies to be received
  2  3 during a stated period.
  2  4    At the hearing, the board shall announce a date certain, no
  2  5 later than thirty days after the date of the hearing, that it
  2  6 will take action to adopt a resolution to participate in the
  2  7 extended school year program for a period not exceeding five
  2  8 years.
  2  9    2.  If the board adopts a resolution to participate in the
  2 10 extended school year program, the district shall participate
  2 11 in the extended school year program unless within twenty-eight
  2 12 days following the action of the board, the secretary of the
  2 13 board receives a petition containing the required number of
  2 14 signatures, asking that an election be called to approve or
  2 15 disapprove the action of the board in adopting the extended
  2 16 school year program.  The petition must be signed by eligible
  2 17 electors equal in number to not less than one hundred or
  2 18 thirty percent of the number of voters at the last preceding
  2 19 regular school election, whichever is greater.  The board
  2 20 shall either rescind its action or direct the county
  2 21 commissioner of elections to submit the question to the
  2 22 qualified electors of the school district at the next
  2 23 following regular school election or a special election held
  2 24 not later than December 1 of the base year.  If a majority of
  2 25 those voting on the question at the election favors
  2 26 disapproval of the action of the board, the district shall not
  2 27 participate in the extended school year program.  If a
  2 28 majority of those voting on the question favors approval of
  2 29 the action, the board shall certify the results of the
  2 30 election to the department of management and the district
  2 31 shall participate in the program.
  2 32    At the expiration of the twenty-eight-day period, if no
  2 33 petition is filed, the board shall certify its action to the
  2 34 department of management and the district shall participate in
  2 35 the program.
  3  1    3.  Participation in an extended school year program is not
  3  2 affected by a change in the boundaries of the school district,
  3  3 except as otherwise provided in this section.  If each school
  3  4 district involved in a school reorganization under chapter 275
  3  5 has approved an extended school year program, and if the
  3  6 voters have not voted upon the question of participation in
  3  7 the program in the reorganized district, the extended school
  3  8 year program shall be in effect for the reorganized district
  3  9 that has been approved for the least amount and the shortest
  3 10 time in any of the districts.
  3 11    Sec. 2.  NEW SECTION.  257.52  PARTICIPATION.
  3 12    Participation by licensed practitioners in the extended
  3 13 school year program is voluntary and the contract for
  3 14 participation is separate from the contract issued under
  3 15 section 279.13.  Compensation for employees who participate in
  3 16 the program shall be paid pursuant to established or
  3 17 negotiated supplemental pay schedules.  An extended school
  3 18 year contract shall be in writing and shall state the number
  3 19 of contract days, the compensation to be paid, and any other
  3 20 matters as may be mutually agreed upon.  The contract shall be
  3 21 for a single school year.  Contracts issued under this section
  3 22 shall be offered and renewed in the manner provided for
  3 23 extracurricular contracts under section 279.19A, subsections
  3 24 2, 7, and 8.
  3 25    Participation in the extended school year program by
  3 26 students is voluntary.
  3 27    Sec. 3.  NEW SECTION.  257.53  FUNDING FOR EXTENDED SCHOOL
  3 28 YEAR PROGRAMS &endash; LEVY &endash; APPROPRIATION.
  3 29    1.  The extended school program shall be funded each year
  3 30 by a combination of an extended school year levy and extended
  3 31 school year state aid.  The board of directors of a school
  3 32 district may certify for levy by April 15 of a school year, a
  3 33 tax on all taxable property in the school district for an
  3 34 extended school year levy.  The revenue from the tax levied in
  3 35 this section shall be placed in the extended school year fund
  4  1 of the school district.
  4  2    2.  Extended school year state aid shall be calculated by
  4  3 the department of management by determining the proportion of
  4  4 regular program district cost of the district for the budget
  4  5 year that is state foundation aid and paying that proportion
  4  6 of the proposed budget as extended school year state aid, with
  4  7 the remainder of the budget funded by the extended school year
  4  8 levy.  Annually, the department of management shall establish
  4  9 the rate of the extended school year levy to be levied and
  4 10 certify it to the school district's county auditor.
  4 11    3.  There is appropriated for each fiscal year from the
  4 12 general fund of the state to the department of management an
  4 13 amount sufficient to pay the extended school year state aid as
  4 14 provided in this section.  Extended school year state aid
  4 15 shall be paid in three equal installments, on April 15, May
  4 16 15, and June 15 of a fiscal year and shall be deposited in the
  4 17 extended school year fund established in section 298A.3A.
  4 18    4.  Moneys received for the extended school year program
  4 19 deposited in the extended school year fund shall be expended
  4 20 only for the purposes described in section 257.51, subsection
  4 21 1.
  4 22    Sec. 4.  NEW SECTION.  298A.3A  EXTENDED SCHOOL YEAR FUND.
  4 23    The extended school year fund is a special revenue fund.
  4 24 An extended school year fund must be established in any school
  4 25 corporation which receives funding for the extended school
  4 26 year program.  Moneys in the fund are miscellaneous income.
  4 27    Sec. 5.  This Act takes effect July 1, 1995, for procedures
  4 28 needed for the provision of an extended school year program
  4 29 for the school year beginning July 1, 1996.  
  4 30                           EXPLANATION
  4 31    This bill establishes an extended school year program
  4 32 beginning July 1, 1996, which boards of school districts may
  4 33 consider implementing.  The program provides school districts
  4 34 with up to 30 additional school days for students or working
  4 35 days for teachers and administrators, or a combination of
  5  1 school days and working days.  If the board wishes to consider
  5  2 participating in the program, the board must hold a public
  5  3 hearing on the issue and a resolution to participate in the
  5  4 program may be adopted.  However, the bill provides that
  5  5 voters opposed to the program may petition for an election and
  5  6 in that case, an election must be held.
  5  7    The program may be approved for up to five years and is
  5  8 funded by a combination of extended school year state aid and
  5  9 extended school year property tax in the same ratio as the
  5 10 state aid and property tax included in the district cost of
  5 11 the district.  The department of management shall determine
  5 12 the amount of state aid to be paid to the school district.
  5 13 The bill provides for an appropriation from the general fund
  5 14 in an amount sufficient to pay the state aid, with the
  5 15 remainder of the budget funded by the extended school year
  5 16 levy.  Revenue from the tax levied and the state aid shall be
  5 17 placed in the extended school year fund the bill directs each
  5 18 school district that receives funding for the program to
  5 19 establish and costs of the program shall be paid from the
  5 20 fund.
  5 21    The bill takes effect July 1, 1995, for procedures needed
  5 22 for the provision of an extended school year program for the
  5 23 school year beginning July 1, 1996.
