1 1 Section 1. Section 321.445, Code 1995, is amended by
1 2 adding the following new subsection:
1 3 NEW SUBSECTION. 6. A person shall not ride, and an
1 4 operator shall not permit a person to ride, in the open bed of
1 5 a motor truck or in an unenclosed area of a motor vehicle on a
1 6 highway unless the person is properly seated on a seat and
1 7 wearing a properly adjusted and fastened seat belt or safety
1 8 harness which meets the requirements of subsection 1. This
1 9 section does not apply to a motor vehicle operated as part of
1 10 a parade, a motorcycle or moped, a military motor vehicle, an
1 11 authorized emergency vehicle, an implement of husbandry, or a
1 12 motor vehicle used to transport hunters and hunting dogs
1 13 during hunting activities.
1 14 EXPLANATION
1 15 This bill prohibits a person from riding in the open bed of
1 16 a truck, for example, the back of a pickup, without being
1 17 properly seated and wearing a seatbelt. The bill does not
1 18 apply to persons who are participating in a parade,
1 19 motorcycles or mopeds, a military motor vehicle, an authorized
1 20 emergency vehicle, an implement of husbandry, or a vehicle
1 21 used for hunting. A violation is punishable as a simple
1 22 misdemeanor and carries a scheduled fine of $10.
