1 1 Section 1. Section 252H.13, Code 1995, is amended by
1 2 adding the following new unnumbered paragraph:
1 3 NEW UNNUMBERED PARAGRAPH. One review of a request for
1 4 review of the support order of a parent may be conducted
1 5 annually when the review is being conducted at the request of
1 6 a parent. The request for review may be made no earlier than
1 7 one year from the entry date of the support order or the most
1 8 recent modification, or the last completed review, whichever
1 9 is later. However, if a request for review is made within the
1 10 last year and was denied because the location of the
1 11 nonrequesting party was unknown at the time of the request, a
1 12 second request may be made within the same year if the
1 13 nonrequesting party is subsequently located. The unit shall
1 14 adopt rules pursuant to chapter 17A to provide for the
1 15 frequency of a request for review of the support order of a
1 16 parent, consistent with this section.
1 17 EXPLANATION
1 18 This bill requires that one review of a support order for
1 19 which the child support recovery unit is providing enforcement
1 20 be allowed, annually, if requested by a parent. The bill also
1 21 allows for a subsequent review within the same year if the
1 22 initial request was denied because the nonrequesting party
1 23 could not be located but has subsequently been located. The
1 24 bill requires the child support recovery unit to adopt rules
1 25 to provide for the frequency of a request for review of a
1 26 child support order under this section.
