PAG LIN 1 1 Section 1. Section 476.2, subsection 7, Code 1995, is 1 2 amended to read as follows: 1 3 7. The board shallnoticeadopt rules concerning the 1 4 filing requirements for energy efficiency plans by rate- 1 5 regulated gas and electric utilitieson or before October 1,1 61990. Rate-regulated gas and electric utilities shall be1 7required to file initial plans no later than four months after1 8the effective date of the rules required by this subsection.1 9The board shall also adopt rules concerning the filing1 10requirements for energy efficiency plansand by all other 1 11 utilities. However, the board shall not require utilities 1 12 other than rate-regulated utilities to file energy efficiency 1 13 plans more often than once every four years. 1 14 EXPLANATION 1 15 This bill prohibits the utilities board from requiring non- 1 16 rate-regulated utilities from filing energy efficiency plans 1 17 more often than once every four years. Currently, the 1 18 utilities board provides by administrative rule that non-rate- 1 19 regulated utilities are required to file energy efficiency 1 20 plans every two years. Non-rate-regulated utilities include 1 21 electric public utilities having fewer than 10,000 customers 1 22 and electric cooperative corporations and associations, 1 23 municipally owned utilities, and gas public utilities having 1 24 fewer than 2,000 customers. 1 25 LSB 1213YH 76 1 26 js/cf/24
