PAG LIN 1 1 HOUSE CONCURRENT RESOLUTION NO. 1 2 BY HARRISON, FALLON, MAIN, BODDICKER, and McCOY 1 3 A Concurrent Resolution to request the establishment 1 4 of a legislative interim committee to study child 1 5 visitation and custody issues. 1 6 WHEREAS, child visitation and custody arrangements 1 7 are often established through an adversarial process 1 8 which may detrimentally affect the possibility of a 1 9 continuing relationship between a child and both 1 10 parents; and 1 11 WHEREAS, traditional custody and visitation 1 12 enforcement actions, such as contempt of court 1 13 proceedings, promote an adversarial climate between 1 14 the parties involved and are not always effective in 1 15 resolving custody and visitation disputes; and 1 16 WHEREAS, the public is interested in improving the 1 17 enforcement of custody and visitation arrangements; 1 18 and 1 19 WHEREAS, mediation and nonadversarial types of 1 20 proceedings are preferable and, based upon preliminary 1 21 studies, are more successful than adversarial 1 22 proceedings in resolving visitation and custody 1 23 disputes; NOW THEREFORE, 1 24 BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES, THE 1 25 SENATE CONCURRING, That the legislative council is 1 26 requested to establish a legislative study committee 1 27 for the 1995 interim to examine issues related to 1 28 child custody and visitation, including but not 1 29 limited to the causes and extent of the problems 1 30 associated with enforcement of child custody and 2 1 visitation orders; the most effective, nonadversarial 2 2 alternatives for resolution of disputes which arise in 2 3 the enforcement of child custody and visitation 2 4 orders; and the role of government and any attendant 2 5 costs of governmental involvement in the enforcement 2 6 process. The committee's membership shall include 2 7 legislators. The committee shall seek input from 2 8 representatives of child advocacy organizations, 2 9 custodial and noncustodial parents, providers of 2 10 services to children and families, the office of the 2 11 attorney general, the judicial department, and other 2 12 interested parties. The committee shall submit a 2 13 report of its findings and recommendations to the 2 14 general assembly by December 15, 1995. 2 15 LSB 2656HH 76 2 16 pf/jw/5
