PAG LIN 1 1 Amend the House amendment, S-5821, to Senate File 1 2 2195, as amended, passed, and reprinted by the Senate, 1 3 as follows: 1 4 #1. By striking page 1, line 5, through page 4, 1 5 line 20, and inserting the following: 1 6 ""Section 1. There is appropriated from the 1 7 general fund of the state to the Iowa communications 1 8 network fund created in section 8D.14 for the fiscal 1 9 year beginning July 1, 1996, and ending June 30, 1997, 1 10 the following amount, or so much thereof as is 1 11 necessary, to be used for the purpose designated: 1 12 For debt service: 1 13 .................................................. $ 12,754,000 1 14 Upon the appropriation of the funds in this section 1 15 to the Iowa communications network fund, the Iowa 1 16 telecommunications and technology commission shall 1 17 immediately transfer $12,754,000 of the appropriated 1 18 amount to a separate fund established in the office of 1 19 the treasurer of state, to be used solely for debt 1 20 service for the Iowa communications network. The 1 21 commission shall certify to the treasurer of state 1 22 when a debt service payment is due, and upon receipt 1 23 of the certification the treasurer shall make the 1 24 payment. The commission shall pay any additional 1 25 amount due from funds deposited in the Iowa 1 26 communications network fund. 1 27 Sec.2. PART III RELATED APPROPRIATIONS. 1 28 1. PART III AUTHORIZED USERS. 1 29 a. There is appropriated from the rebuild Iowa 1 30 infrastructure fund of the state created in section 1 31 8.57, subsection 5, to the Iowa communications network 1 32 fund under the control of the Iowa telecommunications 1 33 and technology commission for the fiscal year 1 34 beginning July 1, 1996, and ending June 30, 1997, the 1 35 following amount, or so much thereof as is necessary, 1 36 to be used for the purpose designated: 1 37 For the connection of a minimum of 110 Part III 1 38 authorized users as determined by the commission and 1 39 communicated to the general assembly: 1 40 .................................................. $ 19,600,095 1 41 b. It is the intent of the general assembly that 1 42 the connection of the authorized user sites pursuant 1 43 to this subsection be awarded based upon the Part III 1 44 contracts executed in 1995. 1 45 c. It is also the intent of the general assembly 1 46 that the commission lease DS-1 or T-1 circuits for 1 47 Part III connections currently using analog 1 48 technology. 1 49 d. Notwithstanding the fact that funds 1 50 appropriated pursuant to this subsection will not be 2 1 made available prior to July 1, 1996, the Iowa 2 2 telecommunications and technology commission is 2 3 authorized to negotiate and enter into contracts for 2 4 ordering necessary equipment related to the completion 2 5 of the connections authorized in paragraph "a" as 2 6 deemed appropriate by the commission upon the 2 7 effective date of this paragraph. 2 8 2. PART III NETWORK COSTS – SUBSIDIZATION FUND. 2 9 There is appropriated from the general fund of the 2 10 state to the Iowa communications network fund created 2 11 in section 8D.14 for the fiscal year beginning July 1, 2 12 1996, and ending June 30, 1997, the following amount, 2 13 or so much thereof as is necessary, to be used for the 2 14 purposes designated in this subsection: 2 15 For the subsidization of video rates for authorized 2 16 users as determined by the commission and consistent 2 17 with chapter 8D: 2 18 .................................................. $ 2,400,000 2 19 ............................................... FTEs 57.00 2 20 3. PART III NETWORK COSTS – MAINTENANCE AND LEASE 2 21 COSTS. 2 22 a. There is appropriated from the rebuild Iowa 2 23 infrastructure fund of the state created in section 2 24 8.57, subsection 5, to the Iowa communications network 2 25 fund under the control of the Iowa telecommunications 2 26 and technology commission for the fiscal year 2 27 beginning July 1, 1996, and ending June 30, 1997, the 2 28 following amount, or so much thereof as is necessary, 2 29 to be used for the purpose designated: 2 30 For maintenance costs and recurring lease costs as 2 31 provided in this subsection: 2 32 .................................................. $ 1,199,905 2 33 b. As a condition of the appropriation in this 2 34 subsection, $209,298 of the amount appropriated shall 2 35 be expended by the Iowa telecommunications and 2 36 technology commission for maintenance costs associated 2 37 with Part III connections of the network. 2 38 c. As a further condition of the appropriation in 2 39 this subsection, $990,607 of the amount appropriated 2 40 shall be expended by the Iowa telecommunications and 2 41 technology commission for recurring lease costs 2 42 associated with Part III connections of the network. 2 43 4. SUPPORT SERVICES. There is appropriated from 2 44 the general fund of the state to the Iowa 2 45 communications network fund created in section 8D.14 2 46 for the fiscal year beginning July 1, 1996, and ending 2 47 June 30, 1997, the following amount, or so much 2 48 thereof as is necessary, to be used for the purposes 2 49 designated: 2 50 For purposes designated in paragraphs "a" and "b", 3 1 and for not more than the following full-time 3 2 equivalent positions: 3 3 .................................................. $ 1,950,000 3 4 ................................................FTEs 10.0 3 5 a. As a condition of the appropriation in this 3 6 subsection, $450,000 of the amount appropriated shall 3 7 be expended by the public broadcasting division of the 3 8 department of education to provide support for 3 9 functions related to the network, including but not 3 10 limited to the following functions: scheduling for 3 11 video classrooms; development of distance learning 3 12 applications; development of a central information 3 13 source on the Internet relating to educational uses of 3 14 the network; second-line technical support for network 3 15 sites; testing and initializing sites onto the 3 16 network; and coordinating the work of the education 3 17 telecommunications council. The division is 3 18 authorized an additional 5.00 FTEs for a total of 3 19 10.00 FTEs for the purpose of providing such support. 3 20 b. As a further condition of the appropriation in 3 21 this subsection, $1,500,000 of the amount appropriated 3 22 shall be allocated by the public broadcasting division 3 23 of the department of education to the regional 3 24 telecommunications councils established in section 3 25 8D.5. The regional telecommunications councils shall 3 26 use the funds to provide technical assistance for 3 27 network classrooms, planning and troubleshooting for 3 28 local area networks, scheduling of video sites, and 3 29 other related support activities. 3 30 5. SPARE PARTS. There is appropriated from the 3 31 rebuild Iowa infrastructure fund of the state created 3 32 in section 8.57, subsection 5, to the Iowa 3 33 communications network fund created in section 8D.14, 3 34 for the fiscal year beginning July 1, 1996, and ending 3 35 June 30, 1997, the following amount, or so much 3 36 thereof as is necessary, to be used for the purpose 3 37 designated: 3 38 For establishing and maintaining a spare parts 3 39 depot related to the network: 3 40 .................................................. $ 220,000 3 41 6. COMPUTERS, INTERNET CONNECTION, AND RELATED 3 42 COSTS. There is appropriated from the rebuild Iowa 3 43 infrastructure fund of the state created in section 3 44 8.57, subsection 5, to the Iowa communications network 3 45 fund created in section 8D.14, for the fiscal year 3 46 beginning July 1, 1996, and ending June 30, 1997, the 3 47 following amount, or so much thereof as is necessary, 3 48 to be used for the purpose designated: 3 49 For the purchase of computer equipment to be used 3 50 in connection with the network, providing for 4 1 connections to the Internet through the use of the 4 2 network, and for maintaining the regional scheduling 4 3 system: 4 4 .................................................. $ 110,000 4 5 Sec. 3. There is appropriated from the general 4 6 fund of the state to the state board of regents for 4 7 the fiscal year beginning July 1, 1996, and ending 4 8 June 30, 1997, the following amount, or so much 4 9 thereof as is necessary, to be used for the purpose 4 10 designated: 4 11 For the center for educational technology at the 4 12 university of northern Iowa to coordinate staff 4 13 development for educators using educational technology 4 14 in this state: 4 15 .................................................. $ 500,000 4 16 Sec. 4. LEGISLATIVE INTENT. 4 17 1. It is the intent of the general assembly that 4 18 the Iowa telecommunications and technology commission 4 19 develop recommendations concerning the expenses which 4 20 should be recovered in the rates established by the 4 21 commission for use of the network, and any necessary 4 22 subsidies. The commission shall file a written report 4 23 concerning these recommendations with the senate 4 24 committee on communications and information policy and 4 25 the house of representatives committee on technology 4 26 by no later than January 13, 1997. 4 27 2. It is also the intent of the general assembly 4 28 that the education telecommunications council and the 4 29 regional telecommunications councils give priority to 4 30 network video usage during the normal school hours for 4 31 grades prekindergarten through twelve at those video 4 32 sites which are located within school district 4 33 facilities. The commission, in consultation with the 4 34 education telecommunications council, shall establish 4 35 a policy for flexibility of use for educational video 4 36 classrooms during normal school hours for events 4 37 unrelated to network use. 4 38 Sec. 5. CONTRACT MODIFICATION. Notwithstanding 4 39 section 8D.13, the commission is authorized to 4 40 negotiate a contract with Sooland Cable involving the 4 41 connection of five Part III sites, to provide for a 4 42 lump-sum payment at the time of installation and 4 43 activation of the circuit which will result in a real 4 44 savings within a range of $23,400 up to $27,000 per 4 45 site when compared to the original contract price. 4 46 Sec. 6. ADDITIONAL CONNECTIONS. 4 47 1. LEWIS CENTRAL HIGH SCHOOL. Notwithstanding 4 48 section 8D.13, subsection 5, the state may own and the 4 49 Iowa telecommunications and technology commission 4 50 shall provide for the construction and connection to 5 1 the Iowa communications network of the Lewis Central 5 2 high school, located in Council Bluffs and contiguous 5 3 to the school for the deaf established under chapter 5 4 270. 5 5 2. ADDITIONS TO PART III. The Iowa 5 6 telecommunications and technology commission may 5 7 contract for construction relating to connections to 5 8 the Iowa communications network for the following 5 9 authorized users which were not identified in the 5 10 original Part III request for proposals, but which 5 11 meet the definition of a Part III user pursuant to 5 12 section 8D.13, subsection 2, paragraph "c": 5 13 a. Meservey-Thornton community school district, 5 14 Thornton. 5 15 b. Eldora state training school, Eldora. 5 16 c. Iowa juvenile home, Toledo. 5 17 d. Four oaks educational center, Cedar Rapids. 5 18 e. Keystone area education agency, Dubuque. 5 19 Sec. 7. EFFECTIVE DATE. 5 20 1. Section 2, subsection 1, paragraph "d", of this 5 21 Act, which authorizes the Iowa telecommunications and 5 22 technology commission to begin negotiations for 5 23 ordering necessary equipment prior to the availability 5 24 of funding, being deemed of immediate importance, 5 25 takes effect upon enactment. 5 26 2. Section 6, subsection 1, of this Act, which 5 27 authorizes the state to construct and own the Iowa 5 28 communications network connection to Lewis Central 5 29 high school, being deemed of immediate importance, 5 30 takes effect upon enactment."" 5 31 SF 2195S 5 32 mj/cc/26
