  1  1    Amend Senate File 2370, as amended, passed, and
  1  2 reprinted by the Senate, as follows:
  1  3    #1.  By striking page 13, line 32, through page 14,
  1  4 line 3, and inserting the following:
  1  5    "Sec.    .  It is the intent of the general
  1  6 assembly that a renewable energy supplier who has
  1  7 proceeded in good faith under the terms and conditions
  1  8 of sections 476.43 and 476.44 not suffer economic loss
  1  9 as a result of action or inaction taken by the state.
  1 10 These persons shall be reimbursed by the utilities for
  1 11 their reasonable good faith development costs as
  1 12 determined by the Iowa utilities board.  A renewable
  1 13 energy supplier shall be deemed to have proceeded in
  1 14 good faith if the supplier has filed a petition by
  1 15 January 1, 1996, which requests enforcement of the
  1 16 provisions of sections 476.43 and 476.44 by requiring
  1 17 an electric utility to enter into a potential contract
  1 18 with the renewable energy supplier and an action is
  1 19 currently pending before the Iowa utilities board."
