1 1 Amend House File 2496 as follows:
1 2 #1. Page 1, by inserting before line 1 the
1 3 following:
1 4 "Section 1. Section 330A.6, subsection 2, Code
1 5 1995, is amended to read as follows:
1 6 2. After the hearing, and if in the best interests
1 7 of the municipality, the municipality shall enact an
1 8 ordinance authorizing the creation of the authority.
1 9 However, within ten days of adoption of the ordinance,
1 10 a petition may be filed requesting that the measure be
1 11 approved by the registered voters of the municipality
1 12 before taking effect. The petition shall meet the
1 13 requirements of section 331.306 or 364.2, as
1 14 applicable. Upon receipt of such a petition, the
1 15 governing body may repeal the ordinance or shall
1 16 direct the county commissioner of elections to call a
1 17 special election for voter approval of the ordinance.
1 18 The results of the referendum are binding on any
1 19 further action of the board pertaining to the
1 20 ordinance."
