  1  1    Amend House File 2423 as follows:
  1  2    #1.  Page 1, by inserting before line 24 the
  1  3 following:
  1  4    "Sec.    .  Section 99F.10, Code Supplement 1995,
  1  5 is amended by adding the following new subsection:
  1  6    NEW SUBSECTION.  7.  Real property used as a dock
  1  7 or for purposes of an excursion gambling boat which is
  1  8 exempt from property taxation under another provision
  1  9 of the law, including being exempt because it is owned
  1 10 by a city, county, state, or charitable or nonprofit
  1 11 entity, may be subject to real property taxation by
  1 12 any taxing district in which the real property used as
  1 13 a dock or for purposes of an excursion gambling boat
  1 14 is located.  To subject such real property to
  1 15 taxation, the governing body of the taxing district
  1 16 shall pass a resolution imposing the tax and shall
  1 17 notify the county assessor, director of revenue and
  1 18 finance, and the owner of record of the real property
  1 19 by September 1 preceding the fiscal year in which the
  1 20 real property taxes are due and payable.  The assessed
  1 21 value shall be determined by the department of revenue
  1 22 and finance by October 15 and the owner may protest
  1 23 the assessed value to the state board of tax review by
  1 24 December 1.  Real property subject to tax as provided
  1 25 in this subsection shall continue to be taxed until
  1 26 such time as the governing body of the taxing district
  1 27 repeals the resolution subjecting the property to
  1 28 taxation."
  1 29    #2.  Title page, line 2, by inserting after the
  1 30 word "enclosure" the following:  "or real property
  1 31 involved in gambling boat operations".
