  1  1    Amend the amendment, H-5541, to Senate File 2448,
  1  2 as amended, passed, and reprinted by the Senate, as
  1  3 follows:
  1  4    #1.  Page 20, by inserting after line 20 the
  1  5 following:
  1  6    "Sec.    .  Section 68B.35, subsection 2, paragraph
  1  7 e, Code 1995, is amended to read as follows:
  1  8    e.  Members of the banking board, the ethics and
  1  9 campaign disclosure board, the credit union review
  1 10 board, the economic development board, the employment
  1 11 appeal board, the environmental protection commission,
  1 12 the health facilities council, the Iowa business
  1 13 investment corporation board of directors, the Iowa
  1 14 finance authority, the Iowa seed capital corporation,
  1 15 the Iowa public employees' retirement system
  1 16 investment board, the lottery board, the natural
  1 17 resource commission, the board of parole, the
  1 18 petroleum underground storage tank fund board, the
  1 19 public employment relations board, the state racing
  1 20 and gaming commission, the state board of regents, the
  1 21 tax review board, the transportation commission, the
  1 22 office of consumer advocate, the utilities board, and
  1 23 any full-time members of other boards and commissions
  1 24 as defined under section 7E.4 who receive an annual
  1 25 salary for their service on the board or commission.
  1 26    Sec.    .  Section 97B.41, subsection 8, paragraph
  1 27 b, subparagraph (13), Code Supplement 1995, is amended
  1 28 to read as follows:
  1 29    (13)  Members of the state transportation
  1 30 commission, and the board of parole, and the state
  1 31 health facilities council unless a member elects by
  1 32 filing an application with the department to be
  1 33 covered under this chapter."
  1 34    #2.  Page 21, by inserting after line 15 the
  1 35 following:
  1 36    "Sec.    .  Section 135C.2, subsection 5,
  1 37 unnumbered paragraph 1, Code Supplement 1995, is
  1 38 amended to read as follows:
  1 39    The department shall establish a special
  1 40 classification within the residential care facility
  1 41 category in order to foster the development of
  1 42 residential care facilities which serve persons with
  1 43 mental retardation, chronic mental illness, a
  1 44 developmental disability, or brain injury, as
  1 45 described under section 225C.26, and which contain
  1 46 five or fewer residents.  A facility within the
  1 47 special classification established pursuant to this
  1 48 subsection is exempt from the requirements of section
  1 49 135.63.  The department shall adopt rules which are
  1 50 consistent with rules previously developed for the
  2  1 waiver demonstration project pursuant to 1986 Iowa
  2  2 Acts, chapter 1246, section 206, and which include all
  2  3 of the following provisions:
  2  4    Sec.    .  Section 135H.6, subsection 4, Code 1995,
  2  5 is amended by striking the subsection.
  2  6    Sec.    .  Section 145.3, subsection 1, Code 1995,
  2  7 is amended to read as follows:
  2  8    1.  The health data commission shall enter into an
  2  9 agreement with the health policy corporation of Iowa
  2 10 or any other corporation, association, or entity it
  2 11 deems appropriate to provide staff for the commission,
  2 12 to provide staff for the compilation, correlation, and
  2 13 development of the data collected by the commission,
  2 14 to conduct or contract for studies on health-related
  2 15 questions which will further the purpose and intent
  2 16 expressed in section 145.1, and to provide data to the
  2 17 health facilities council as requested by the Iowa
  2 18 department of public health.  The agreement may
  2 19 provide for the corporation, association, or entity to
  2 20 prepare and distribute or make available data to
  2 21 health care providers, health care subscribers, third-
  2 22 party payers, and the general public."
  2 23    #3.  Page 21, by inserting after line 47 the
  2 24 following:
  2 25    "Sec.    .  Section 231B.2, subsection 1, Code
  2 26 1995, is amended to read as follows:
  2 27    1.  The department shall establish by rule in
  2 28 accordance with chapter 17A a special classification
  2 29 for elder group homes.  An elder group home
  2 30 established pursuant to this subsection is exempt from
  2 31 the requirements of section 135.63."
  2 32    #4.  Page 22, by inserting after line 27 the
  2 33 following:
  2 34    "Sec.    .  Sections 135.61, 135.62, and 135.64
  2 35 through 135.83, Code 1995, are repealed.
  2 36    Sec.    .  Section 135.63, Code Supplement 1995, is
  2 37 repealed."
