  1  1    Amend House File 2477 as follows:
  1  2    #1.  Page 32, by inserting after line 25 the
  1  3 following:
  1  4    "Sec. 101.  NEW SECTION.  261.110  DEFINITIONS.
  1  5    As used in this division, unless the context
  1  6 otherwise requires:
  1  7    1.  "Accredited higher education institution" means
  1  8 a public or private institution of higher learning
  1  9 located in Iowa that meets the requirements
  1 10 established in section 261.92, subsection 1.
  1 11    2.  "Commission" means the college student aid
  1 12 commission.
  1 13    3.  "Full-time resident student" means an
  1 14 individual resident of Iowa who is enrolled at an
  1 15 accredited higher education institution located in
  1 16 Iowa in a course of study including at least twelve
  1 17 semester hours or the trimester equivalent of twelve
  1 18 semester hours or the quarter equivalent of twelve
  1 19 semester hours.  "Course of study" does not include
  1 20 correspondence courses.
  1 21    4.  "Grant" means an award by the state of Iowa to
  1 22 an accredited higher education institution for a
  1 23 qualified resident student under the Iowa military
  1 24 service grant program.
  1 25    5.  "Part-time resident student" means an
  1 26 individual resident of Iowa who is enrolled at an
  1 27 accredited higher education institution located in
  1 28 Iowa in a course of study including at least three
  1 29 semester hours or the trimester or the four quarter
  1 30 equivalent of three semester hours.  "Course of study"
  1 31 does not include correspondence courses.
  1 32    6.  "Qualified student" means a resident student
  1 33 who entered military service on or after January 1,
  1 34 1994, has received an honorable discharge from a
  1 35 branch of the armed services of the United States of
  1 36 America or the state military forces, after having
  1 37 served a minimum of four years on active duty, and who
  1 38 is making satisfactory progress toward graduation.
  1 39    Sec. 102.  NEW SECTION.  261.111  PROGRAM
  1 40 ESTABLISHED – ELIGIBILITY.
  1 41    An Iowa military service grant program is
  1 42 established.  A military service grant may be awarded
  1 43 to a resident of Iowa who is admitted and in
  1 44 attendance as a full-time or part-time resident
  1 45 student at an accredited higher education institution
  1 46 and who has received an honorable discharge from a
  1 47 branch of the armed services of the United States of
  1 48 America or the state military forces, after having
  1 49 served a minimum of four years on active duty.  The
  1 50 individual's permanent residence during the years of
  2  1 service on active duty shall have been in Iowa.
  2  2 Grants awarded shall be distributed to the appropriate
  2  3 accredited higher education institution for payment of
  2  4 educational expenses, including tuition, room, board,
  2  5 and mandatory fees, with any balance to be distributed
  2  6 to the student for whom the grant is awarded.
  2  7    Sec. 103.  NEW SECTION.  261.112  EXTENT OF GRANT.
  2  8    A qualified full-time resident student may receive
  2  9 grants for not more than eight semesters of
  2 10 undergraduate study or the trimester or quarter
  2 11 equivalent.  A qualified part-time resident student
  2 12 may receive grants for not more than sixteen semesters
  2 13 of undergraduate study or the trimester or quarter
  2 14 equivalent.
  2 15    Sec. 104.  NEW SECTION.  261.113  AMOUNT OF GRANT.
  2 16    1.  The amount of a grant to a qualified full-time
  2 17 student for an academic year shall be one thousand
  2 18 dollars.
  2 19    2.  The amount of a grant to a qualified part-time
  2 20 student enrolled in a course of study shall be equal
  2 21 to the average amount of a grant to a full-time
  2 22 student times a number which represents twenty-four
  2 23 semester hours, or the trimester or quarter
  2 24 equivalent, divided by the number of hours in which
  2 25 the part-time student is actually enrolled.
  2 26    3.  A grant may be made annually for both the fall
  2 27 and spring semesters or the trimester equivalent.
  2 28 Payments under the grant shall be allocated equally
  2 29 among the semesters or trimesters and shall be paid at
  2 30 the beginning of each semester or trimester, upon
  2 31 certification by the accredited higher education
  2 32 institution that the student is admitted and in
  2 33 attendance.  If the student discontinues attendance
  2 34 before the end of the semester or trimester after
  2 35 receiving payment under the grant, the entire amount
  2 36 of any refund due that student, up to the amount of
  2 37 any payments made under the annual grant, shall be
  2 38 paid by the accredited higher education institution to
  2 39 the state.
  2 40    Sec. 105.  NEW SECTION.  261.114  ADMINISTRATION BY
  2 41 COMMISSION – RULES.
  2 42    The commission shall administer this program and
  2 43 shall:
  2 44    1.  Provide application forms to qualified students
  2 45 enrolled and attending or seeking to enroll and attend
  2 46 an accredited higher education institution.
  2 47    2.  Adopt rules for defining tuition and mandatory
  2 48 fees, defining residence for the purposes of the Iowa
  2 49 military service grant program, and processing and
  2 50 approving applications for grants.  In determining who
  3  1 is a resident of Iowa, the commission's rules shall be
  3  2 at least as restrictive as those of the board of
  3  3 regents.
  3  4    3.  Approve and award grants to accredited higher
  3  5 education institutions under the program.
  3  6    4.  Report annually to the governor and general
  3  7 assembly and include in the report an evaluation of
  3  8 the Iowa military service grant program for the
  3  9 period.  The commission may require the accredited
  3 10 higher education institution to promptly furnish any
  3 11 information that the commission may request in
  3 12 connection with the Iowa military service grant
  3 13 program.
  3 14    5.  Provide for the proration of funds among
  3 15 qualified applicants if funds available are
  3 16 insufficient to pay all approved grants.
  3 17    6.  Contact the appropriate officials from each
  3 18 branch of the armed services of the United States and
  3 19 the adjutant general of the state to determine the
  3 20 number of possible eligible applicants for this
  3 21 program.
  3 22    Sec. 106.  NEW SECTION.  261.115  APPLICATION FOR
  3 23 GRANTS.
  3 24    Each applicant, in accordance with the rules of the
  3 25 commission, shall:
  3 26    1.  Complete and file an application for a grant on
  3 27 forms provided by the commission.
  3 28    2.  Submit promptly information requested by the
  3 29 commission.
  3 30    3.  File a new application annually, by which the
  3 31 applicant's eligibility for a renewed grant will be
  3 32 evaluated and determined.
  3 33    Sec. 107.  NEW SECTION.  261.116  APPROPRIATION.
  3 34    There is appropriated from the general fund of the
  3 35 state to the college student aid commission funds
  3 36 sufficient to pay the Iowa military service tuition
  3 37 grants approved pursuant to this division."
