  1  1    Amend House File 2433 as follows:
  1  2    #1.  Page 2, by inserting after line 3 the
  1  3 following:
  1  4    "Sec.    .  Section 455D.11, subsection 5, Code
  1  5 1995, is amended to read as follows:
  1  6    5.  a.  The department shall develop criteria for
  1  7 the issuance of permits and shall issue permits to
  1  8 qualified stockpiling facilities.  The department
  1  9 shall inform the owner or operator of a waste tire
  1 10 collection site or processing site of the specific
  1 11 permit required for the waste tire collection site or
  1 12 processing site and any variance possibilities.
  1 13    b.  The department shall specify in writing to a
  1 14 person who applies for a permit or variance from the
  1 15 permit requirement of this section the department's
  1 16 reasons for denying the permit or variance.  A person
  1 17 denied a permit or variance may appeal the denial to
  1 18 the commission pursuant to chapter 17A.
  1 19    c.  The department shall process an application for
  1 20 a permit or variance in a timely manner and shall
  1 21 issue a permit or variance immediately upon
  1 22 determining that the person applying for a permit or
  1 23 variance complies with the requirements for obtaining
  1 24 the permit or variance."
  1 25    #2.  Title page, line 6, by inserting after the
  1 26 word "vehicles," the following:  "pertaining to
  1 27 obtaining a permit or variance for storing or using
  1 28 waste tires,".
  1 29    #3.  By renumbering as necessary.
