  1  1    Amend House File 2190 as follows:
  1  2    #1.  Page 1, by inserting before line 1 the
  1  3 following:
  1  4    "Section 1.  Section 331.302, subsections 7, 8, and
  1  5 10, Code 1995, are amended to read as follows:
  1  6    7.  A resolution becomes effective upon passage and
  1  7 an ordinance or amendment becomes a law when a summary
  1  8 of the ordinance or the complete text of the ordinance
  1  9 is published, unless a subsequent effective date is
  1 10 provided within the measure.  As used in this
  1 11 paragraph, "summary" shall mean a narrative
  1 12 description of the terms and conditions of an
  1 13 ordinance setting forth the main points of the
  1 14 ordinance in a manner calculated to inform the public
  1 15 in a clear and understandable manner the meaning of
  1 16 the ordinance and which shall provide the public with
  1 17 sufficient notice to conform to the desired conduct
  1 18 required by the ordinance.  The description shall
  1 19 include the title of the ordinance, an accurate and
  1 20 intelligible abstract or synopsis of the essential
  1 21 elements or the ordinance, a statement that the
  1 22 description is a summary, the location and the normal
  1 23 business hours of the office where the ordinance may
  1 24 be inspected, when the ordinance becomes effective,
  1 25 and the full text of any provisions imposing fines,
  1 26 penalties, forfeitures, fees, or taxes.  Legal
  1 27 descriptions of property set forth in ordinances shall
  1 28 be described in full, provided that maps or charts may
  1 29 be substituted for legal descriptions when they
  1 30 contain sufficient detail to clearly define the area
  1 31 with which the ordinance is concerned.  The narrative
  1 32 description shall be written in a clear and coherent
  1 33 manner and shall, to the extent possible, avoid the
  1 34 use of technical or legal terms not generally familiar
  1 35 to the public.  When necessary to use technical or
  1 36 legal terms not generally familiar to the public, the
  1 37 narrative description shall include definitions of
  1 38 those terms.
  1 39    8.  The auditor shall promptly record each measure,
  1 40 publish a summary of all ordinances or a complete text
  1 41 of the ordinances and amendments as provided in
  1 42 section 331.305, authenticate all measures except
  1 43 motions with signature and certification as to time
  1 44 and manner of publication, if any, and maintain for
  1 45 public use copies of all effective ordinances and
  1 46 codes.  A copy of the complete text of an ordinance or
  1 47 amendment shall also be available for distribution to
  1 48 the public at the office of the county auditor.  The
  1 49 auditor's certification is presumptive evidence of the
  1 50 facts stated therein.
  2  1    10.  The compensation paid to a newspaper for a
  2  2 publication required by this section shall not exceed
  2  3 three-fourths of the fee provided in section 618.11.
  2  4 The compensation paid to a newspaper for publication
  2  5 of the complete text of an ordinance shall not exceed
  2  6 three-fourths of the fee provided in section 618.11."
  2  7    #2.  Page 1, by inserting before line 1 the
  2  8 following:
  2  9    "Sec.    .  Section 380.7, subsection 2, Code 1995,
  2 10 is amended to read as follows:
  2 11    2.  Publish a summary of all ordinances or the
  2 12 complete text of ordinances and amendments in the
  2 13 manner provided in section 362.3.  As used in this
  2 14 paragraph, "summary" shall mean a narrative
  2 15 description of the terms and conditions of an
  2 16 ordinance setting forth the main points of the

  2 49 three-fourths of the fee provided in section 618.11.
  2 50 The compensation paid to a newspaper for publication
  3  1 of the complete text of an ordinance shall not exceed
  3  2 three-fourths of the fee provided in section 618.11."
  3  3    #4.  Title page, line 1, by striking the words
  3  4 "setting the compensation for" and inserting the
  3  5 following:  "the".
  3  6    #5.  Title page, line 2, by striking the word
  3  7 "notices" and inserting the following:  "notices,
  3  8 ordinances, and amendments".
  3  9    #6.  By renumbering as necessary.
