1 1 Amend House File 2165 as follows:
1 2 #1. Page 4, line 5, by inserting after the figure
1 3 "4" the following: "unless the municipality elects to
1 4 proceed under subsection 5".
1 5 #2. Page 5, by striking lines 7 through 18 and
1 6 inserting the following:
1 7 "NEW SUBSECTION. 5. In lieu of making a claim for
1 8 replacement moneys under the allocation provisions of
1 9 subsection 4 for any applicable fiscal year, a
1 10 municipality may elect to reduce the amount of
1 11 assessed value of property defined in section 403.19,
1 12 subsection 1, by an amount equal to that portion of
1 13 the amount of such assessed value which is assessed
1 14 pursuant to section 427B.17, subsection 3. The
1 15 applicable assessment roll and ordinance providing for
1 16 the division of taxes under section 403.19 in the
1 17 urban renewal taxing district shall be deemed to be
1 18 modified to the extent of such annual adjustment
1 19 without further action on the part of the city or
1 20 county implementing the urban renewal taxing
1 21 district."
1 22 #3. Page 5, by inserting after line 27 the
1 23 following:
1 24 "Sec. . NEW SECTION. 427B.19D APPEAL FOR
1 25 STATE ASSISTANCE.
1 26 For fiscal years beginning on or after July 1,
1 27 1996, a municipality in which is located an urban
1 28 renewal district for which debt was incurred prior to
1 29 June 30, 1996, may appeal to the state appeal board
1 30 for state assistance to meet the debt obligations for
1 31 the fiscal year if such debt is not secured by an
1 32 assessment agreement pursuant to section 403.6,
1 33 subsection 19, and if the urban renewal area contains
1 34 property assessed pursuant to section 427B.17. The
1 35 appeal shall be made by May 15 preceding the fiscal
1 36 year on forms approved by the department of
1 37 management."
