  1 11    Section 1.  There is appropriated from the general
  1 12 fund of the state to the department of education for
  1 13 the fiscal year beginning July 1, 1995, and ending
  1 14 June 30, 1996, the following amounts, or so much
  1 15 thereof as may be necessary, to be used for the
  1 16 purposes designated:
  1 17    1.  GENERAL ADMINISTRATION
  1 18    For salaries, support, maintenance, miscellaneous
  1 19 purposes, and for not more than the following full-
  1 20 time equivalent positions:

  1 23    One of the full-time equivalent positions provided
  1 24 for under this subsection shall be filled by an
  1 25 individual hired by the department of education to
  1 26 direct and administer the management information
  1 27 system.  The individual hired shall possess a
  1 28 background in education and administrative experience
  1 29 at the community college level.
  1 30    The department of education shall conduct a study
  1 31 of the possible uses for the remaining portion of the
  1 32 interest earned on the permanent school fund after transfers
  1 33 are made pursuant to section 257B.1A, subsections 2 and 3.
  1 34 The department shall submit a report of its findings and
  1 35 recommendations to the general assembly and the legislative
  1 36 fiscal bureau by January 1, 1996.
  1 37    The department of education shall conduct a study
  1 38 of chapter 299, the compulsory education law of this
  1 39 state, in cooperation with interested individuals from
  1 40 throughout the state.  The department shall submit a
  1 41 report of the findings and recommendations to the
  1 42 general assembly by January 1, 1996.
  1 43    2.  VOCATIONAL EDUCATION ADMINISTRATION
  1 44    For salaries, support, maintenance, miscellaneous
  1 45 purposes, and for not more than the following full-
  1 46 time equivalent positions:

  1 49    3.  VOCATIONAL REHABILITATION DIVISION
  1 50    a.  For salaries, support, maintenance,

  2  5    It is the intent of the general assembly that the
  2  6 division of vocational rehabilitation services of the
  2  7 department of education shall seek, in addition to
  2  8 state appropriations, funds other than federal funds,
  2  9 which may include but are not limited to local funds,
  2 10 for purposes of matching federal vocational
  2 11 rehabilitation funds.
  2 12    Notwithstanding the full-time equivalent position
  2 13 limit established in this subsection for the fiscal
  2 14 year ending June 30, 1996, if federal funding is
  2 15 available to pay the costs of additional employees for
  2 16 the vocational rehabilitation division who would have
  2 17 duties relating to vocational rehabilitation services
  2 18 paid for through federal funding, authorization to
  2 19 hire not more than four full-time equivalent employees
  2 20 shall be provided, the full-time equivalent position
  2 21 limit shall be exceeded, and the additional employees
  2 22 shall be hired by the division.
  2 23    b.  For matching funds for programs to enable
  2 24 severely physically or mentally disabled persons to
  2 25 function more independently, including salaries and
  2 26 support, and for not more than the following full-time

  3 17    To assist a vocational agriculture youth
  3 18 organization sponsored by the schools to support the
  3 19 foundation established by that vocational agriculture
  3 20 youth organization and for other youth activities:

  3 22    11.  CAREER PATHWAYS PROGRAM
  3 23    For purposes of developing and implementing a
  3 24 career pathways program to expand opportunities for
  3 25 youth and adults to become prepared for and succeed in

  3 28    Of the funds appropriated in this subsection, for
  3 29 the fiscal year beginning July 1, 1995, and ending

  3 33 employed shall possess a background in business and
  3 34 secondary and postsecondary education.
  3 35    12.  FAMILY RESOURCE CENTERS
  3 36    For support of the family resource center
  3 37 demonstration program established under chapter 256C:

  3 39    13.  CAREER OPPORTUNITY PROGRAM
  3 40    For purposes of providing assistance to minority
  3 41 persons who major in fields or subject areas where
  3 42 minorities are currently underrepresented or

  3 44 by this Act:

  3 46    14.  PUBLIC BROADCASTING DIVISION
  3 47    For salaries, support, maintenance, capital
  3 48 expenditures, miscellaneous purposes, and for not more

  4  2    Of the full-time equivalent positions provided for
  4  3 under this subsection for the fiscal year beginning
  4  4 July 1, 1995, and ending June 30, 1996, it is the
  4  5 intent of the general assembly that 4.0 full-time
  4  6 equivalent positions be provided for purposes formerly
  4  7 provided for under the Star Schools program.
  4  8    The public broadcasting division shall conduct a
  4  9 study, in collaboration with all entities receiving
  4 10 services via the Iowa communications network, of the
  4 11 efficiencies of the network and shall make
  4 12 recommendations relating to the elimination of
  4 13 duplicative efforts.  The study shall include an
  4 14 investigation of the duties and functions of employees
  4 15 of the division, other state agencies, area education
  4 16 agencies, and public schools, if those duties and
  4 17 functions involve the Iowa communications network.
  4 18 The division shall submit a report of its findings and
  4 19 recommendations to the general assembly and the
  4 20 legislative fiscal bureau by January 1, 1996.
  4 21    15.  NATIONAL ASSESSMENT OF EDUCATION PROGRESS
  4 22 (NAEP)
  4 23    For participation by the department of education in
  4 24 a state and national project to determine the academic
  4 25 achievement of Iowa students in math, reading,
  4 26 science, United States history, or geography:  
  4 27 .................................................. $     50,000
  4 28    16.  LOCAL ARTS COMPREHENSIVE EDUCATIONAL
  4 29 STRATEGIES (LACES)
  4 30    For contracting with the Iowa alliance for arts
  4 31 education to execute the local arts comprehensive
  4 32 educational strategies program (LACES):  
  4 33 .................................................. $     25,000
  4 34    The department of education and the Iowa alliance
  4 35 for arts education shall jointly develop grant
  4 36 applications and select grant recipients for the local
  4 37 arts comprehensive educational strategies program.  At
  4 38 least 50 percent of the funds appropriated by the
  4 39 general assembly for the fiscal year beginning July 1,
  4 40 1995, and ending June 30, 1996, for purposes of the
  4 41 local arts comprehensive educational strategies
  4 42 program, shall be allocated to schools which are new
  4 43 participants in the program.
  4 44    17.  ADVANCED PLACEMENT
  4 45    For purposes of awarding matching grants to schools
  4 46 to be used for instructional staff development so that
  4 47 additional advanced placement courses may be offered
  4 48 at K-12 public schools:  
  4 49 .................................................. $     75,000
  4 50    Schools that receive grants under this subsection
  5  1 shall provide a local match or other matching
  5  2 financial support and shall coordinate instructional
  5  3 staff development with a public postsecondary
  5  4 institution.  
  5  5    18.  VOCATIONAL EDUCATION TO SECONDARY SCHOOLS
  5  6    For reimbursement for vocational education
  5  7 expenditures made by secondary schools:  
  5  8 .................................................. $  3,308,850
  5  9    Funds appropriated in this subsection shall be used
  5 10 for expenditures made by school districts to meet the
  5 11 standards set in sections 256.11, 258.4, and 260C.14
  5 12 as a result of the enactment of 1989 Iowa Acts,
  5 13 chapter 278.  Funds shall be used as reimbursement for
  5 14 vocational education expenditures made by secondary
  5 15 schools in the manner provided by the department of
  5 16 education for implementation of the standards set in
  5 17 1989 Iowa Acts, chapter 278.
  5 18    19.  COMMUNITY COLLEGES
  5 19    Notwithstanding chapter 260D, for general state
  5 20 financial aid, including general financial aid to
  5 21 merged areas in lieu of personal property tax
  5 22 replacement payments under section 427A.13, to merged
  5 23 areas as defined in section 260C.2, for vocational
  5 24 education programs in accordance with chapters 258 and
  5 25 260C, to purchase instructional equipment for
  5 26 vocational and technical courses of instruction in
  5 27 community colleges, and for salary increases:

  5 29    The funds appropriated in this subsection shall be

  5 46    Sec. 2.  Notwithstanding 1994 Iowa Acts, chapter
  5 47 1193, section 2, subsection 2, funds appropriated and
  5 48 allocated to the merged areas pursuant to 1994 Iowa
  5 49 Acts, chapter 1193, section 2, for the fiscal year
  5 50 beginning July 1, 1994, and ending June 30, 1995,
  6  1 pursuant to section 8.53, unnumbered paragraph 1,
  6  2 shall be paid to the merged areas by June 30, 1995.
  6  3    Sec. 3.  The department of education shall, in
  6  4 consultation with the Iowa association of community
  6  5 college presidents and the Iowa association of
  6  6 community college trustees, conduct a study of funding
  6  7 for community colleges, and shall make specific
  6  8 recommendations on the elimination of chapter 260D and
  6  9 for alternatives to present community college funding
  6 10 including, but not limited to, a plan for distribution
  6 11 of funds to community colleges.  The department shall
  6 12 submit a report of its findings and recommendations to
  6 13 the governor and the general assembly by December 1,
  6 14 1995.  
  6 15             COLLEGE STUDENT AID COMMISSION
  6 16    Sec. 4.  There is appropriated from the general
  6 17 fund of the state to the college student aid
  6 18 commission for the fiscal year beginning July 1, 1995,
  6 19 and ending June 30, 1996, the following amounts, or so
  6 20 much thereof as may be necessary, to be used for the
  6 21 purposes designated:
  6 22    1.  GENERAL ADMINISTRATION
  6 23    For salaries, support, maintenance, miscellaneous
  6 24 purposes, and for not more than the following full-
  6 25 time equivalent positions:  
  6 26 .................................................. $    321,256
  6 27 ............................................... FTEs       7.05
  6 28    From the moneys appropriated in this subsection,
  6 29 $15,000 for the fiscal year beginning July 1, 1995,
  6 30 and ending June 30, 1996, shall be expended to provide
  6 31 grants to students who would meet the requirements for
  6 32 receipt of a vocational-technical tuition grant, but
  6 33 who are enrolled in a licensed school of cosmetology
  6 34 arts and sciences under chapter 157, or a licensed
  6 35 barber school under chapter 158.  The amount of the
  6 36 grant made by the college student aid commission
  6 37 pursuant to this subsection shall be not less than
  6 38 $300 or the amount of the student's established
  6 39 financial need.
  6 40    2.  UNIVERSITY OF OSTEOPATHIC MEDICINE AND HEALTH
  6 41 SCIENCES
  6 42    a.  For forgivable loans to Iowa students attending
  6 43 the university of osteopathic medicine and health
  6 44 sciences, under the forgivable loan program pursuant
  6 45 to section 261.19A:  
  6 46 .................................................. $    379,260
  6 47    b.  For the university of osteopathic medicine and
  6 48 health sciences for an initiative in primary health
  6 49 care to direct primary care physicians to shortage
  6 50 areas in the state:  
  7  1 .................................................. $    395,000
  7  2    The moneys appropriated in this lettered paragraph
  7  3 shall be used as follows:
  7  4    (1)  To reduce student loan debt for primary care
  7  5 physicians in an amount not to exceed $30,000 per
  7  6 student for a four-year period of medical service in
  7  7 medically under-served areas of the state.
  7  8    (2)  For tuition scholarships for students
  7  9 attending the university of osteopathic medicine and
  7 10 health sciences who agree to practice primary care
  7 11 medicine in medically under-served areas of the state.
  7 12 The student shall practice in the state two years for
  7 13 every year of tuition.  A person receiving funds under
  7 14 this subparagraph shall not be eligible for funds
  7 15 under subparagraph (1).
  7 16    (3)  For general administration costs of the
  7 17 university for the primary care initiative, the
  7 18 university shall expend an amount not to exceed
  7 19 $50,000.
  7 20    The university of osteopathic medicine and health
  7 21 sciences shall report quarterly to the legislative
  7 22 fiscal bureau concerning the expenditure of funds used
  7 23 pursuant to subparagraphs (1), (2), and (3) of this
  7 24 lettered paragraph.  The university shall also submit
  7 25 the annual audit of the university to the legislative
  7 26 fiscal bureau within six months following the year
  7 27 being audited.  The college student aid commission
  7 28 shall not provide moneys for subparagraphs (1) and (2)
  7 29 of this lettered paragraph until the university has
  7 30 signed and submitted contracts for the use of these
  7 31 moneys for reduction of student loan debt and tuition
  7 32 scholarships.  Funds for subparagraph (3) of this
  7 33 lettered paragraph shall be provided quarterly to the
  7 34 university.  Notwithstanding section 8.33, the funds
  7 35 for this lettered paragraph shall not revert to the
  7 36 general fund but be available for expenditure the
  7 37 following fiscal year for purposes of subparagraphs
  7 38 (1) and (2).
  7 39    3.  STUDENT AID PROGRAMS
  7 40    For payments to students for the Iowa grant
  7 41 program:  
  7 42 .................................................. $  1,469,790
  7 43    From the moneys appropriated in this subsection,
  7 44 $1,397,790 for the fiscal year beginning July 1, 1995,
  7 45 and ending June 30, 1996, shall be expended for an
  7 46 Iowa grant program, with funds to be allocated to
  7 47 institutions pursuant to section 261.93A.  The
  7 48 remainder shall be allocated for the graduate student
  7 49 financial assistance program.
  7 50    Sec. 5.  There is appropriated from the loan
  8  1 reserve account to the college student aid commission
  8  2 for the fiscal year beginning July 1, 1995, and ending
  8  3 June 30, 1996, the following amount, or so much
  8  4 thereof as may be necessary, to be used for the
  8  5 purposes designated:
  8  6    For operating costs of the Stafford loan program
  8  7 including salaries, support, maintenance,
  8  8 miscellaneous purposes, and for not more than the
  8  9 following full-time equivalent positions:

  8 12                 STATE BOARD OF REGENTS
  8 13    Sec. 6.  There is appropriated from the general
  8 14 fund of the state to the state board of regents for
  8 15 the fiscal year beginning July 1, 1995, and ending
  8 16 June 30, 1996, the following amounts, or so much
  8 17 thereof as may be necessary, to be used for the
  8 18 purposes designated:
  8 19    1.  OFFICE OF STATE BOARD OF REGENTS
  8 20    a.  For salaries, support, maintenance,
  8 21 miscellaneous purposes, and for not more than the
  8 22 following full-time equivalent positions:

  8 25    If the moneys provided in this lettered paragraph
  8 26 are augmented by reimbursements from the institutions
  8 27 under the control of the state board of regents for
  8 28 the funding of the office of the state board of
  8 29 regents, the office shall report quarterly such
  8 30 reimbursements to the chairpersons and ranking members
  8 31 of the joint appropriations subcommittee on education.
  8 32    b.  For allocation by the state board of regents to
  8 33 the state university of Iowa, the Iowa state
  8 34 university of science and technology, and the
  8 35 university of northern Iowa to reimburse the
  8 36 institutions for deficiencies in their operating funds
  8 37 resulting from the pledging of tuitions, student fees
  8 38 and charges, and institutional income to finance the
  8 39 cost of providing academic and administrative
  8 40 buildings and facilities and utility services at the
  8 41 institutions:

  8 43    The state board of regents, the department of
  8 44 management, and the legislative fiscal bureau shall
  8 45 cooperate to determine and agree upon, by November 15,
  8 46 1995, the amount that needs to be appropriated for
  8 47 tuition replacement for the fiscal year beginning July
  8 48 1, 1996.
  8 49    c.  For funds to be allocated to the southwest Iowa
  8 50 graduate studies center:

  9 24 of Iowa college of medicine for family practice
  9 25 faculty and support staff.
  9 26    It is the intent of the general assembly that the
  9 27 university place additional emphasis on the locum
  9 28 tenus program.
  9 29    c.  University hospitals
  9 30    For salaries, general support, maintenance,
  9 31 equipment, and miscellaneous purposes and for medical
  9 32 and surgical treatment of indigent patients as
  9 33 provided in chapter 255, and for not more than the
  9 34 following full-time equivalent positions:

  9 37    The university of Iowa hospitals and clinics shall
  9 38 submit quarterly a report regarding the portion of the
  9 39 appropriation in this lettered paragraph expended on
  9 40 general support in a format jointly developed by the
  9 41 university of Iowa hospitals and clinics, the
  9 42 legislative fiscal bureau, and the department of
  9 43 management which delineates the expenditures and
  9 44 purposes of the funds.
  9 45    Funds appropriated in this lettered paragraph shall
  9 46 not be used to perform abortions except medically
  9 47 necessary abortions, and shall not be used to operate
  9 48 the early termination of pregnancy clinic except for
  9 49 the performance of medically necessary abortions.  For
  9 50 the purpose of this lettered paragraph, an abortion is
 10  1 the purposeful interruption of pregnancy with the
 10  2 intention other than to produce a live-born infant or
 10  3 to remove a dead fetus, and a medically necessary
 10  4 abortion is one performed under one of the following
 10  5 conditions:
 10  6    (1)  The attending physician certifies that
 10  7 continuing the pregnancy would endanger the life of
 10  8 the pregnant woman.
 10  9    (2)  The attending physician certifies that the
 10 10 fetus is physically deformed, mentally deficient, or
 10 11 afflicted with a congenital illness.
 10 12    (3)  The pregnancy is the result of a rape which is
 10 13 reported within 45 days of the incident to a law
 10 14 enforcement agency or public or private health agency
 10 15 which may include a family physician.
 10 16    (4)  The pregnancy is the result of incest which is
 10 17 reported within 150 days of the incident to a law
 10 18 enforcement agency or public or private health agency
 10 19 which may include a family physician.
 10 20    (5)  The abortion is a spontaneous abortion,
 10 21 commonly known as a miscarriage, wherein not all of
 10 22 the products of conception are expelled.
 10 23    The total quota allocated to the counties for
 10 24 indigent patients for the fiscal year beginning July
 10 25 1, 1995, shall not be lower than the total quota
 10 26 allocated to the counties for the fiscal year
 10 27 commencing July 1, 1994.  The total quota shall be
 10 28 allocated among the counties on the basis of the 1990
 10 29 census pursuant to section 255.16.
 10 30    d.  Psychiatric hospital
 10 31    For salaries, support, maintenance, equipment, and
 10 32 miscellaneous purposes and for the care, treatment,
 10 33 and maintenance of committed and voluntary public
 10 34 patients, and for not more than the following full-

 12 27 advanced driving simulator in fiscal years beginning
 12 28 July 1, 1996, and July 1, 1997, shall only be expended
 12 29 upon receiving notification from the national highway
 12 30 traffic safety administration that the United States
 12 31 congress has authorized the construction of the
 12 32 national advanced driving simulator, that federal
 12 33 funds have been appropriated to begin construction,
 12 34 and that delivery of the motion base, graphics system,
 12 35 and integrating software will take place in
 12 36 substantial compliance with the United States
 12 37 department of transportation's acquisition schedule as
 12 38 set forth in the cooperative agreement between the
 12 39 state university of Iowa and the national highway
 12 40 traffic safety administration.

 13 19 summit shall examine strategies regarding the
 13 20 expansion of export and trade opportunities with
 13 21 Canada and Mexico for agricultural, commercial, and
 13 22 telecommunications, durable goods and other
 13 23 manufactured products and services, due to the
 13 24 ratification of the North American free trade
 13 25 agreement, especially strategies to increase exports
 13 26 of agricultural products and businesses in rural
 13 27 communities, for assisting small and medium-sized
 13 28 businesses which do not currently export or trade with
 13 29 Canada or Mexico to initiate such trade, and for
 13 30 developing intermodal transportation systems to
 13 31 establish a Laredo to Duluth North American free trade
 13 32 agreement trade corridor.  The summit shall also
 13 33 examine the activities of other states regarding
 13 34 efforts to promote trade with Canada or Mexico and the
 13 35 potential for cooperative efforts with other states,

 15  7 regents may use notes, bonds, or other evidences of
 15  8 indebtedness issued under section 262.48 to finance
 15  9 projects that will result in energy cost savings in an
 15 10 amount that will cause the state board to recover the
 15 11 cost of the projects within an average of six years.
 15 12    Sec. 9.  MEDICAL ASSISTANCE &endash; SUPPLEMENTAL
 15 13 AMOUNTS.  For the fiscal year beginning July 1, 1995,
 15 14 and ending June 30, 1996, the department of human
 15 15 services shall continue the supplemental
 15 16 disproportionate share and a supplemental indirect
 15 17 medical education adjustment applicable to state-owned
 15 18 acute care hospitals with more than 500 beds and shall
 15 19 reimburse qualifying hospitals pursuant to that
 15 20 adjustment with a supplemental amount for services
 15 21 provided medical assistance recipients.  The
 15 22 adjustment shall generate supplemental payments
 15 23 intended to equal the state appropriation made to a
 15 24 qualifying hospital for treatment of indigent patients
 15 25 as provided in chapter 255.  To the extent of the
 15 26 supplemental payments, a qualifying hospital shall,
 15 27 after receipt of the funds, transfer to the department
 15 28 of human services an amount equal to the actual
 15 29 supplemental payments that were made in that month.
 15 30 The aggregate amounts for the fiscal year shall not
 15 31 exceed the state appropriation made to the qualifying
 15 32 hospital for treatment of indigent patients as
 15 33 provided in chapter 255.  The department of human
 15 34 services shall deposit the portion of these funds
 15 35 equal to the state share in the department's medical
 15 36 assistance account and the balance shall be credited
 15 37 to the general fund of the state.  To the extent that
 15 38 state funds appropriated to a qualifying hospital for
 15 39 the treatment of indigent patients as provided in
 15 40 chapter 255 have been transferred to the department of
 15 41 human services as a result of these supplemental
 15 42 payments made to the qualifying hospital, the
 15 43 department shall not, directly or indirectly, recoup
 15 44 the supplemental payments made to a qualifying
 15 45 hospital for any reason, unless an equivalent amount
 15 46 of the funds transferred to the department of human
 15 47 services by a qualifying hospital pursuant to this
 15 48 provision is transferred to the qualifying hospital by
 15 49 the department.
 15 50    If the state supplemental amount allotted to the
 16  1 state of Iowa for the federal fiscal year beginning
 16  2 October 1, 1995, and ending September 30, 1996,
 16  3 pursuant to section 1923 (f)(3) of the federal Social
 16  4 Security Act, as amended, or pursuant to federal
 16  5 payments for indirect medical education is greater
 16  6 than the amount necessary to fund the federal share of
 16  7 the supplemental payments specified in the preceding
 16  8 paragraph, the department of human services shall
 16  9 increase the supplemental disproportionate share or
 16 10 supplemental indirect medical education adjustment by
 16 11 the lesser of the amount necessary to utilize fully
 16 12 the state supplemental amount or the amount of state
 16 13 funds appropriated to the state university of Iowa
 16 14 general education fund and allocated to the university
 16 15 for the college of medicine.  The state university of
 16 16 Iowa shall transfer from the allocation for the
 16 17 college of medicine to the department of human
 16 18 services, on a monthly basis, an amount equal to the
 16 19 additional supplemental payments made during the
 16 20 previous month pursuant to this paragraph.  A
 16 21 qualifying hospital receiving supplemental payments
 16 22 pursuant to this paragraph that are greater than the
 16 23 state appropriation made to the qualifying hospital
 16 24 for treatment of indigent patients as provided in
 16 25 chapter 255 shall be obligated as a condition of its
 16 26 participation in the medical assistance program to
 16 27 transfer to the state university of Iowa general
 16 28 education fund on a monthly basis an amount equal to
 16 29 the funds transferred by the state university of Iowa
 16 30 to the department of human services.  To the extent
 16 31 that state funds appropriated to the state university
 16 32 of Iowa and allocated to the college of medicine have
 16 33 been transferred to the department of human services
 16 34 as a result of these supplemental payments made to the
 16 35 qualifying hospital, the department shall not,
 16 36 directly or indirectly, recoup these supplemental
 16 37 payments made to a qualifying hospital for any reason,
 16 38 unless an equivalent amount of the funds transferred
 16 39 to the department of human services by the state
 16 40 university of Iowa pursuant to this paragraph is
 16 41 transferred to the qualifying hospital by the
 16 42 department.
 16 43    Continuation of the supplemental disproportionate
 16 44 share and supplemental indirect medical education
 16 45 adjustment shall preserve the funds available to the
 16 46 university hospital for medical and surgical treatment
 16 47 of indigent patients as provided in chapter 255 and to
 16 48 the state university of Iowa for educational purposes
 16 49 at the same level as provided by the state funds
 16 50 initially appropriated for that purpose.
 17  1    The department of human services shall, in any
 17  2 compilation of data or other report distributed to the
 17  3 public concerning payments to providers under the
 17  4 medical assistance program, set forth reimbursements
 17  5 to a qualifying hospital through the supplemental
 17  6 disproportionate share and supplemental indirect
 17  7 medical education adjustment as a separate item and
 17  8 shall not include such payments in the amounts
 17  9 otherwise reported as the reimbursement to a
 17 10 qualifying hospital for services to medical assistance
 17 11 recipients.
 17 12    For purposes of this section, "supplemental
 17 13 payment" means a supplemental payment amount paid for
 17 14 medical assistance to a hospital qualifying for that
 17 15 payment under this section.

 18 23 14, remaining unencumbered or unobligated on June 30,
 18 24 1995, shall not revert to the general fund of the
 18 25 state but shall be available for purposes of the Iowa
 18 26 grant program, in addition to funds appropriated in
 18 27 section 4, subsection 3, of this Act, with funds to be
 18 28 distributed pursuant to section 261.93A.
 18 29    Sec. 13.  Notwithstanding section 257B.1A,
 18 30 subsection 4, and 1994 Iowa Acts, chapter 1193,
 18 31 section 15, for the fiscal year beginning July 1,
 18 32 1994, and ending June 30, 1995, the remaining portion
 18 33 of the interest earned on the permanent school fund
 18 34 shall, after transfers are made pursuant to section
 18 35 257B.1A, subsections 2 and 3, be deposited in the
 18 36 interest for Iowa schools fund established under this
 18 37 Act.
 18 38    Sec. 14.  There is appropriated from the
 18 39 scholarship and tuition grant reserve fund to the
 18 40 college student aid commission for the fiscal year
 18 41 beginning July 1, 1995, and ending June 30, 1996, the
 18 42 amount of $160,000 for purposes of the work-study
 18 43 program, in addition to funds appropriated in section
 18 44 261.85.
 18 45    Sec. 15.  Funds appropriated for state scholarships
 18 46 pursuant to section 261.25, subsection 2, for the
 18 47 fiscal year beginning July 1, 1995, and ending June
 18 48 30, 1996, shall be used in their entirety to fund
 18 49 scholarships to eligible students, and the college
 18 50 student aid commission shall not place an across-the-
 19  1 board ceiling on the amount distributed under the
 19  2 state scholarship program.
 19  3    Sec. 16.  Section 257B.1, subsection 5, Code 1995,
 19  4 is amended by striking the subsection.
 19  5    Sec. 17.  Section 257B.1A, Code 1995, is amended by
 19  6 striking the section and inserting in lieu thereof the
 19  7 following:
 19  8    257B.1A  TRANSFER OF INTEREST.
 19  9    1.  The interest for Iowa schools fund is
 19 10 established in the office of treasurer of state.  The
 19 11 department of revenue and finance shall deposit
 19 12 interest earned on the permanent school fund in the
 19 13 interest for Iowa schools fund.  Moneys in the
 19 14 interest for Iowa schools fund shall be transferred or
 19 15 allocated only for school purposes as provided in this
 19 16 section.
 19 17    2.  For a transfer of moneys from the interest for
 19 18 Iowa schools fund to the first in the nation in
 19 19 education foundation, prior to July 1, October 1,
 19 20 January 1, and March 1 of each year, the governing
 19 21 board of the first in the nation in education
 19 22 foundation established in section 257A.2 shall certify
 19 23 to the treasurer of state the cumulative total value
 19 24 of contributions received under section 257A.7 for
 19 25 deposit in the first in the nation in education fund
 19 26 and for the use of the foundation.  The cumulative
 19 27 total value of contributions received includes the
 19 28 value of the amount deposited in the national center
 19 29 endowment fund established in section 263.8A in excess
 19 30 of eight hundred seventy-five thousand dollars.  The
 19 31 value of in-kind contributions shall be based upon the
 19 32 fair market value of the contribution determined for
 19 33 income tax purposes.
 19 34    The portion of the interest in Iowa schools fund
 19 35 that is equal to the cumulative total value of
 19 36 contributions, less the portion of the interest in
 19 37 Iowa schools fund dedicated to the national center for
 19 38 gifted and talented education, is dedicated to the
 19 39 first in the nation in education foundation for that
 19 40 year.  The interest earned on this dedicated amount
 19 41 shall be transferred by the treasurer of state to the
 19 42 credit of the first in the nation in education
 19 43 foundation.
 19 44    3.  For a transfer of moneys from the interest in
 19 45 Iowa schools fund to the national center endowment
 19 46 fund established in section 263.8A, prior to July 1,
 19 47 October 1, January 1, and March 1 of each year, the
 19 48 state university of Iowa shall certify to the
 19 49 treasurer of state the cumulative total value of
 19 50 contributions received and deposited in the national
 20  1 center endowment fund.  Within fifteen days following
 20  2 certification by the state university of Iowa, the
 20  3 treasurer of state shall transfer from the interest in
 20  4 Iowa schools fund to the national center an amount
 20  5 equal to one-half the cumulative total value of the
 20  6 contributions deposited in the national center
 20  7 endowment fund, not to exceed eight hundred seventy-
 20  8 five thousand dollars.
 20  9    Sec. 18.  NEW SECTION.  260C.24  PAYMENT OF
 20 10 APPROPRIATION.
 20 11    Payment of appropriations for distribution under
 20 12 this chapter or of appropriations made in lieu of such
 20 13 appropriations, shall be made by the department of
 20 14 revenue and finance in monthly installments due on or
 20 15 about the fifteenth of each month of a budget year,
 20 16 and installments shall be as nearly equal as possible,
 20 17 as determined by the department of revenue and
 20 18 finance, taking into consideration the relative budget
 20 19 and cash position of the state resources.
 20 20    Sec. 19.  NEW SECTION.  260C.29  CAREER OPPORTUNITY
 20 21 PROGRAM &endash; MISSION.
 20 22    1.  The mission of the career opportunity program
 20 23 established in this section is to encourage
 20 24 collaborative efforts by a community college, the
 20 25 institutions under the control of the state board of
 20 26 regents, and business and industry to enhance the
 20 27 educational opportunities and provide for job creation
 20 28 and career advancement for Iowa's minority persons by
 20 29 providing assistance to minority persons who major in
 20 30 fields or subject areas where minorities are currently
 20 31 underrepresented or underutilized.
 20 32    2.  A career opportunity program is established to
 20 33 be administered by the community college located in a
 20 34 county with a population in excess of three hundred
 20 35 thousand.  The community college shall provide office
 20 36 space for the efficient operation of the program.  The
 20 37 community college shall employ a director for the
 20 38 program.  The director of the program shall employ
 20 39 necessary support staff.  The director and staff shall
 20 40 be employees of the community college.
 20 41    3.  The director of the program shall do the
 20 42 following:
 20 43    a.  Direct the coordination of the program between
 20 44 the community college and the institutions of higher
 20 45 education under the control of the state board of
 20 46 regents.
 20 47    b.  Propose rules to the state board of education
 20 48 as necessary to implement the program.
 20 49    c.  Recruit minority persons into the program.
 20 50    d.  Enlist the assistance and cooperation of
 21  1 leaders from business and industry to provide job
 21  2 placement services for students who are successfully
 21  3 completing the program.
 21  4    e.  Prepare and submit an annual report to the
 21  5 governor and the general assembly by January 15.
 21  6    4.  To be eligible for the program, a minority
 21  7 person shall be a resident of Iowa who is accepted for
 21  8 admission at or attends a community college or an
 21  9 institution of higher education under the control of
 21 10 the state board of regents.  In addition, the person
 21 11 shall major in or achieve credit toward an associate
 21 12 degree, a bachelor's degree, or a master's degree in a
 21 13 field or subject area where minorities are
 21 14 underrepresented or underutilized.
 21 15    5.  The amount of assistance provided to a student
 21 16 under this section shall not exceed the cost of
 21 17 tuition, fees, and books required for the program in
 21 18 which the student is enrolled and attends.  As used in
 21 19 this section, "books" may include book substitutes,
 21 20 including reusable workbooks, loose-leaf or bound
 21 21 manuals, and computer software materials used as book
 21 22 substitutes.  A student who meets the qualifications
 21 23 of this section shall receive assistance under this
 21 24 section for not more than the equivalent of two full
 21 25 years of study.
 21 26    6.  For purposes of this section, "minority person"
 21 27 means a person who is Black, Hispanic, Asian, or a
 21 28 Pacific Islander, American Indian, or an Alaskan
 21 29 native American.
 21 30    Sec. 20.  Section 260D.14A, unnumbered paragraphs 1
 21 31 and 5, Code 1995, are amended to read as follows:
 21 32    The department of education shall provide for the
 21 33 establishment of a community college excellence 2000
 21 34 account in the office of the treasurer of state for
 21 35 deposit of moneys appropriated to the account for
 21 36 purposes of funding quality instructional centers and
 21 37 program and administrative sharing agreements under
 21 38 sections 260C.45 and 260C.46.  There is appropriated
 21 39 from the general fund of the state to the department
 21 40 of education for the fiscal year beginning July 1,
 21 41 1995 1997, an amount equal to two and five-tenths
 21 42 percent of the total state general aid generated for
 21 43 all community colleges during the budget year under
 21 44 this chapter for deposit in the community college
 21 45 excellence 2000 account.  In the next succeeding two
 21 46 fiscal years, the percent multiplier shall be
 21 47 increased in equal increments until the multiplier
 21 48 reaches seven and one-half percent of the total state
 21 49 general aid generated for all community colleges
 21 50 during the budget year.
 22  1    It is the intent of the general assembly that the
 22  2 general assembly enact legislation by July 1, 1995
 22  3 1997, that will increase the maximum percent
 22  4 multiplier established in this section from seven and
 22  5 five-tenths percent to ten percent.
 22  6    Sec. 21.  Section 261.12, subsection 1, paragraph
 22  7 b, Code 1995, is amended to read as follows:
 22  8    b.  For the fiscal year beginning July 1, 1989
 22  9 1995, and for each following fiscal year, two thousand
 22 10 six nine hundred fifty dollars.
 22 11    Sec. 22.  Section 261.25, subsection 1, Code 1995,
 22 12 is amended to read as follows:
 22 13    1.  There is appropriated from the general fund of
 22 14 the state to the commission for each fiscal year the
 22 15 sum of thirty-two thirty-five million four six hundred
 22 16 twenty-two sixty-four thousand three seven hundred
 22 17 sixty-two fifty dollars for tuition grants.
 22 18    Sec. 23.  NEW SECTION.  261.51  CHIROPRACTIC
 22 19 GRADUATE STUDENT FORGIVABLE LOANS.
 22 20    1.  A chiropractic graduate student forgivable loan
 22 21 program is established, to be administered by the
 22 22 college student aid commission for resident graduate
 22 23 students who are enrolled at Iowa chiropractic
 22 24 colleges and universities.  A resident graduate
 22 25 student attending an Iowa chiropractic college or
 22 26 university is eligible for loan forgiveness under the
 22 27 program if the student meets all of the following
 22 28 conditions:
 22 29    a.  The student graduates from an Iowa chiropractic
 22 30 college or university that meets the requirements for
 22 31 approval under section 151.4.
 22 32    b.  The student has completed a chiropractic
 22 33 residency program.
 22 34    c.  The student practices in the state of Iowa.
 22 35    d.  The student has made application for, using the
 22 36 procedures specified in section 261.16, and received
 22 37 moneys through the college student aid commission from
 22 38 the funds allocated for loans under this section.
 22 39    2.  Of the moneys loaned to an eligible student,
 22 40 for each year of up to and including four years of
 22 41 practice in Iowa, the amount of one thousand one
 22 42 hundred dollars shall be forgiven.  If a student fails
 22 43 to complete a year of practice in the state, the loan
 22 44 amount for that year shall not be forgiven.
 22 45 Forgivable loans made to eligible students shall not
 22 46 become due, for repayment purposes, until after the
 22 47 student has completed the student's residency.
 22 48    3.  For purposes of this section "graduate student"
 22 49 means a student who has completed at least ninety
 22 50 semester hours, or the trimester or quarter
 23  1 equivalent, of postsecondary course work at a public
 23  2 higher education institution or at an accredited
 23  3 private institution, as defined under section 261.9.
 23  4 The college student aid commission shall adopt rules,
 23  5 consistent with rules used for students enrolled in
 23  6 higher education institutions under the control of the
 23  7 state board of regents, for purposes of determining
 23  8 Iowa residency status of graduate students under this
 23  9 section.  The commission shall also adopt rules which
 23 10 provide standards, guidelines, and procedures for the
 23 11 receipt, processing, and administration of student
 23 12 applications and loans under this section.
 23 13    Sec. 24.  Section 261.85, unnumbered paragraph 1,
 23 14 Code 1995, is amended to read as follows:
 23 15    There is appropriated from the general fund of the
 23 16 state to the commission for each fiscal year the sum
 23 17 of two million eight nine hundred ninety-eight fifty
 23 18 thousand eight hundred forty dollars for the work-
 23 19 study program.
 23 20    Sec. 25.  Section 262.2, Code 1995, is amended to
 23 21 read as follows:
 23 22    262.2  APPOINTMENT &endash; TERM OF OFFICE.
 23 23    1.  The members shall be appointed by the governor
 23 24 subject to confirmation by the senate.  The term of
 23 25 each member of the board shall be for six years.  The
 23 26 terms of three members of the board shall begin and
 23 27 expire in each odd-numbered year as provided in
 23 28 section 69.19.
 23 29    2.  The recognized student government organization
 23 30 at each of the three institutions of higher learning
 23 31 under the control of the board shall submit, at least
 23 32 biennially, to the executive director who shall
 23 33 transfer to the governor a list of at least three
 23 34 names of students eligible to represent the
 23 35 institution on the board.  The governor may appoint
 23 36 the ninth member of the board from the lists of names
 23 37 submitted by the recognized student organizations.
 23 38    Sec. 26.  Section 275.55A, Code 1995, is amended to
 23 39 read as follows:
 23 40    275.55A  ATTENDANCE IN OTHER DISTRICT.
 23 41    A pupil student enrolled in ninth, tenth, or
 23 42 eleventh grade during the school year preceding the
 23 43 effective date of a dissolution proposal, who was a
 23 44 resident of the school district that dissolved, may
 23 45 enroll in any a school district to which territory of
 23 46 the school district that dissolved was attached until
 23 47 that pupil's the student's graduation from high
 23 48 school, unless the student was expelled or suspended
 23 49 from school and the conditions of expulsion or
 23 50 suspension have not been met.  The student under
 24  1 expulsion or suspension shall not be enrolled until
 24  2 the board of directors of the school district to which
 24  3 territory of the dissolved school district was
 24  4 attached approves, by majority vote, the enrollment of
 24  5 the student.  Notwithstanding section 282.24, the
 24  6 district of residence of the pupil student, determined
 24  7 in the dissolution proposal, shall pay tuition to the
 24  8 school district selected by the pupil student in an
 24  9 amount not to exceed the district cost per pupil of
 24 10 the district of residence and the school district
 24 11 selected by the pupil student shall accept that
 24 12 tuition payment and enroll the pupil student.
 24 13    Sec. 27.  Section 282.4, Code 1995, is amended to
 24 14 read as follows:
 24 15    282.4  SUSPENSION &endash; EXPULSION &endash; DISMISSAL.
 24 16    1.  The board may, by a majority vote, expel any
 24 17 pupil student from school for a violation of the
 24 18 regulations or rules established by the board, or when
 24 19 the presence of the pupil student is detrimental to
 24 20 the best interests of the school.  The board may
 24 21 confer upon any teacher, principal, or superintendent
 24 22 the power temporarily to dismiss suspend a pupil
 24 23 student, notice of such dismissal the suspension being
 24 24 at once given in writing to the president of the
 24 25 board.
 24 26    2.  A pupil student who commits an assault, as
 24 27 defined under section 708.1, against a school employee
 24 28 in a school building, on school grounds, or at a
 24 29 school-sponsored function shall be suspended for a
 24 30 time to be determined by the principal.  Notice of the
 24 31 suspension shall be immediately sent to the president
 24 32 of the board.  By special meeting or at the next
 24 33 regularly scheduled board meeting, the board shall
 24 34 review the suspension and decide whether to hold a
 24 35 disciplinary hearing to determine whether or not to
 24 36 order further sanctions against the pupil student,
 24 37 which may include expelling the pupil student.  In
 24 38 making its decision, the board shall consider the best
 24 39 interests of the school district, which shall include
 24 40 what is best to protect and ensure the safety of the
 24 41 school employees and pupils students from the pupil
 24 42 student committing the assault.
 24 43    A pupil student shall not be suspended or expelled
 24 44 pursuant to this section if the suspension or
 24 45 expulsion would violate the federal Individuals with
 24 46 Disabilities Education Act.
 24 47    3.  Notwithstanding section 282.6, if a student has
 24 48 been expelled or suspended from school and has not met
 24 49 the conditions of the expulsion or suspension and if
 24 50 the student, or the parent or guardian of the student,
 25  1 changes district of residence, the student shall not
 25  2 be enrolled in the new district of residence until the
 25  3 board of directors of the new district of residence
 25  4 approves, by a majority vote, the enrollment of the
 25  5 student.
 25  6    Sec. 28.  Section 282.5, Code 1995, is amended to
 25  7 read as follows:
 25  8    282.5  READMISSION OF STUDENT.
 25  9    When a student is dismissed suspended by a teacher,
 25 10 principal, or superintendent, pursuant to section
 25 11 282.4, the student may be readmitted by the teacher,
 25 12 principal, or superintendent, but when expelled by the
 25 13 board the student may be readmitted only by the board
 25 14 or in the manner prescribed by the board.
 25 15    Sec. 29.  Section 294A.25, subsection 8, Code 1995,
 25 16 is amended to read as follows:
 25 17    8.  For the fiscal year beginning July 1, 1994
 25 18 1995, to the department of education from phase III
 25 19 moneys the amount of one million two hundred fifty
 25 20 thousand dollars for support for the operations of the
 25 21 new Iowa schools development corporation and for
 25 22 school transformation design and implementation
 25 23 projects administered by the corporation.  Of the
 25 24 amount provided in this subsection, one hundred fifty
 25 25 thousand dollars shall be used for the school and
 25 26 community planning initiative.
 25 27    Sec. 30.  Section 303.3, subsection 3, Code 1995,
 25 28 is amended to read as follows:
 25 29    3.  Notwithstanding section 8.33, moneys committed
 25 30 to grantees under contract that remain unexpended on
 25 31 June 30 of any fiscal year shall not revert but shall
 25 32 be available for expenditure for purposes of the
 25 33 contract program until June 30 of the succeeding
 25 34 fiscal year.
 25 35    Sec. 31.  FUNDS TRANSFERRED.
 25 36    1.  For the fiscal year beginning July 1, 1995, and
 25 37 ending June 30, 1996, the amount of $150,000 is to be
 25 38 paid to the department of education from additional
 25 39 funds transferred from phase I to phase III for
 25 40 development of a K-12 and community college management
 25 41 information system.  Notwithstanding section 294A.20,
 25 42 if the additional funds transferred from phase I to
 25 43 phase III are insufficient for purposes of the
 25 44 appropriation provided under this subsection, moneys
 25 45 allocated to phase III, which would otherwise revert
 25 46 to the general fund under section 294A.20, shall be
 25 47 transferred to the department in an amount sufficient
 25 48 to fully fund the appropriation made under this
 25 49 subsection.  The department shall submit a report to
 25 50 the legislative fiscal bureau by January 1, 1996,
 26  1 describing the specific expenditure of funds
 26  2 appropriated by the general assembly for purposes of
 26  3 the management information system; the estimated time
 26  4 of completion of the system; the department's
 26  5 accomplishments under the system; and any
 26  6 recommendations for future system funding needs.
 26  7    2.  For the fiscal year beginning July 1, 1995, and
 26  8 ending June 30, 1996, up to $50,000 from additional
 26  9 funds transferred from phase I to phase III is to be
 26 10 paid to the department of education for support of the
 26 11 Iowa mathematics and science coalition.  If funds
 26 12 available from the specified sources are insufficient
 26 13 to fully fund the appropriation, the amount
 26 14 appropriated to the department under this subsection
 26 15 shall be reduced to an amount equal to the available
 26 16 funds.
 26 17    Sec. 32.  1994 Iowa Acts, chapter 1193, section 15,
 26 18 is repealed.
 26 19    Sec. 33.  Sections 2, 11 through 13, 16, 17, 26
 26 20 through 28, 30, and this section of this Act, being
 26 21 deemed of immediate importance, take effect upon
 26 22 enactment.""
