  1  1    Amend House File 303 as follows:
  1  2    #1.  Page 37, by inserting after line 33 the
  1  3 following:
  1  4    "Sec.    .  NEW SECTION.  480.9  LIABILITY FOR
  1  5 OWNER OF FARMLAND.
  1  6    An owner of farmland used in a farm operation, as
  1  7 defined in section 352.2, who complies with the
  1  8 requirements of this chapter shall not be held
  1  9 responsible for any damages to an underground
  1 10 facility, including fiber optic cable, if the damage
  1 11 occurred on the farmland in the normal course of the
  1 12 farm operation, unless the owner intentionally damaged
  1 13 the underground facility or acted with wanton
  1 14 disregard or recklessness in causing the damage to the
  1 15 underground facility.  For purposes of this section,
  1 16 an "owner" includes a family member, employee, or
  1 17 tenant of the owner."
