1 1 Amend the amendment, H-4081, to Senate File 481, as
1 2 amended, passed, and reprinted by the Senate, as
1 3 follows:
1 4 #1. By striking page 10, line 28, through page 11,
1 5 line 26.
1 6 #2. Page 11, by striking lines 28 through 30.
1 7 #3. Page 11, by striking lines 34 through 37 and
1 8 inserting the following: "include additional
1 9 counties. The committee shall evaluate the benefits".
1 10 #4. Page 13, by inserting after line 1 the
1 11 following:
1 12 "Sec. . NEW SECTION. 321.179 COUNTY
1 13 TREASURERS &endash; ISSUANCE OF MOTOR VEHICLE LICENSES.
1 14 1. Notwithstanding the provisions of this chapter
1 15 or chapter 321L which grant sole authority to the
1 16 department for the issuance of motor vehicle licenses,
1 17 nonoperator's identification cards, and handicapped
1 18 identification devices, the counties of Adams, Cass,
1 19 Fremont, Mills, Montgomery, and Page shall be
1 20 authorized to issue motor vehicle licenses,
1 21 nonoperator's identification cards, and handicapped
1 22 identification devices on a permanent basis. However,
1 23 a county shall only be authorized to issue commercial
1 24 driver's licenses if certified to do so by the
1 25 department. If a county fails to meet the standards
1 26 for certification under this section, the department
1 27 itself shall provide for the issuance of commercial
1 28 driver's licenses in that county. The department
1 29 shall certify the county treasurers in the permanent
1 30 counties to issue commercial driver's licenses if all
1 31 of the following conditions are met:
1 32 a. The driving skills test is the same as that
1 33 which would otherwise be administered by the state.
1 34 b. The county examiner contractually agrees to
1 35 comply with the requirements of 49 C.F.R. } 383.75,
1 36 adopted as of a specific date by rule by the
1 37 department.
1 38 c. The department provides supervision over the
1 39 issuance of commercial driver's licenses and the
1 40 administration of written tests by the county
1 41 treasurers.
1 42 2. The county treasurers shall be subject to the
1 43 supervision of the department and shall be considered
1 44 agents of the department when performing motor vehicle
1 45 licensing functions."
1 46 #5. By renumbering as necessary.
