  1  1    Amend the amendment, H-3985, to Senate File 481, as
  1  2 amended, passed, and reprinted by the Senate, as
  1  3 follows:
  1  4    #1.  Page 6, by inserting after line 22 the
  1  5 following:
  1  6    "Sec.    .  Section 321.465, unnumbered paragraph
  1  7 2, Code 1995, is amended to read as follows:
  1  8    If an officer upon weighing a vehicle and load
  1  9 determines that the weight is unlawful, the officer
  1 10 may require the driver to stop the vehicle in a
  1 11 suitable place until such portion of the load is
  1 12 removed as may be necessary to reduce the gross weight
  1 13 of the vehicle to the limit as permitted under this
  1 14 chapter.  All material so unloaded shall be cared for
  1 15 by the owner or operator of the vehicle at the risk of
  1 16 the owner or operator.  The owner or operator of an
  1 17 overweight vehicle, designed to transport solid waste
  1 18 and domiciled within the state, which is transporting
  1 19 solid waste, shall not be required to unload any
  1 20 portion of the load, if the load is indivisible, in a
  1 21 place other than a facility which is permitted to
  1 22 handle solid waste disposal, processing, or recycling.
  1 23 However, a vehicle designed to transport solid waste
  1 24 shall not be determined to be in violation of the
  1 25 weight restrictions of this chapter if the gross
  1 26 weight of the vehicle and load is no greater than two
  1 27 thousand pounds over the weight restrictions of this
  1 28 chapter.  For purposes of this section "solid waste"
  1 29 means waste which is acceptable at a local sanitary
  1 30 landfill and the solid waste shall be considered to be
  1 31 an indivisible load.
  1 32    Sec.    .  Section 321.473, unnumbered paragraph 3,
  1 33 Code 1995, is amended to read as follows:
  1 34    Any person who violates the provisions of the
  1 35 ordinance or resolution shall, upon conviction or a
  1 36 plea of guilty, be subject to a fine determined by
  1 37 dividing the difference between the actual weight and
  1 38 the maximum weight established by the ordinance or
  1 39 resolution by one hundred, and multiplying the
  1 40 quotient by two dollars.  However, a person who
  1 41 violates the provisions of the ordinance or resolution
  1 42 with respect to a rubbish vehicle shall not be subject
  1 43 to a fine under this section if the rear axle weight
  1 44 of the rubbish vehicle does not exceed the maximum
  1 45 allowed axle weight by more than two thousand pounds."
