PAG LIN 1 1 Amend Senate File 83, as amended, passed, and 1 2 reprinted by the Senate, as follows: 1 3 #1. Page 1, by inserting after line 6 the 1 4 following: 1 5 "Sec. . Section 257.6, subsection 1, unnumbered 1 6 paragraph 3, Code 1995, is amended to read as follows: 1 7 A school district shall certify its actual 1 8 enrollment to the department of education by October 1 1 9 of each year, and the department shall promptly 1 10 forward the information to the department of 1 11 management. The department of management shall 1 12 determine whether a district is entitled to an advance 1 13 for increasing enrollment on the basis of its actual 1 14 enrollment. 1 15 Sec. . Section 257.6, subsection 4, Code 1995, 1 16 is amended to read as follows: 1 17 4. Budget enrollment. Budget enrollment for the 1 18 budget year is the basic enrollment for the budget 1 19 year. However, if a district's actual enrollment for 1 20 a budget year is greater than its budget enrollment, 1 21 the district is eligible for an advance for increasing 1 22 enrollment as provided in section 257.13. 1 23 Sec. . NEW SECTION. 257.13 ADVANCE FOR 1 24 INCREASING ENROLLMENT. 1 25 If a district's actual enrollment for the budget 1 26 year, determined under section 257.6, is greater than 1 27 its budget enrollment for the budget year, the 1 28 district is granted an advance from the state of an 1 29 amount equal to the product of one-half of its regular 1 30 program district cost per pupil for the budget year 1 31 multiplied by the difference between the actual 1 32 enrollment for the budget year and the budget 1 33 enrollment for the budget year. The advance is 1 34 miscellaneous income. 1 35 If a district receives an advance under this 1 36 section for a budget year, the department of 1 37 management shall determine the amount of the advance 1 38 which would have been generated by local property tax 1 39 revenues if the actual enrollment for the budget year 1 40 had been used in determining district cost for that 1 41 budget year, shall reduce, but not by more than the 1 42 amount of the advance, the district's total state 1 43 school aids otherwise available under this chapter for 1 44 the next following budget year by the amount so 1 45 determined, and shall increase the district's 1 46 additional property tax levy for the next following 1 47 budget year by the amount necessary to compensate for 1 48 the reduction in state aid, so that the local property 1 49 tax for the next following year will be increased only 1 50 by the amount which it would have been increased in 2 1 the budget year if the enrollment calculated in this 2 2 section could have been used to establish the levy. 2 3 There is appropriated each fiscal year from the 2 4 general fund of the state to the department of 2 5 education the amount required to pay advances 2 6 authorized under this section, which shall be paid to 2 7 school districts in the same manner as other state 2 8 aids are paid under section 257.16." 2 9 #2. Section 265.6, Code 1995, is amended to 2 12 read as follows: 2 13 265.6 STATE AID APPLICABLE. 2 14 If the state board of regents has established a 2 15 laboratory school, it shall receive state aid pursuant 2 16 to chapters 256B and 257 for each pupil enrolled in 2 17 the laboratory school in the same amount as the public 2 18 school district in which the pupil resides would 2 19 receive aid for that pupil and shall transmit the 2 20 amount received to the institution of higher education 2 21 at which the laboratory school has been established. 2 22 If the board of a school district terminates a 2 23 contract with the state board of regents for 2 24 attendance of pupils in a laboratory school, the 2 25 school district shall inform the department of 2 26 management of the number of these pupils who are 2 27 enrolled in the district on the third Friday of the 2 28 following September. The department of management 2 29 shall pay to the school district, from funds 2 30 appropriated in section 257.16, an amount equal to the 2 31 amount of state aid paid for each pupil in that school 2 32 district for that school year in payments made as 2 33 provided in section 257.16. However, payments shall 2 34 not be made for pupils for whom an advance is received 2 35 by the district under section 257.13." 2 36 #3.
