PAG LIN 1 1 Amend the amendment, H-3765, to Senate File 462, as 1 2 amended, passed, and reprinted by the Senate, as 1 3 follows: 1 4 #1. Page 3, by inserting after line 48 the 1 5 following: 1 6 "# . By striking page 34, line 14, through page 1 7 35, line 26, and inserting the following: 1 8 "Sec. 100. PERSONAL ASSISTANCE SERVICES. 1 9 1. The department of human services, in 1 10 consultation with the personal assistance and family 1 11 support services council created in section 225C.48, 1 12 shall submit a request to the United States department 1 13 of health and human services to amend the mental 1 14 retardation and the ill and handicapped home and 1 15 community-based services waivers to include the 1 16 provision of consumer-directed attendant care as a 1 17 fundable service under the medical assistance home and 1 18 community-based services waiver. If approved, the 1 19 consumer-directed attendant care services portion of 1 20 the waiver as provided in 1994 Iowa Acts, chapter 1 21 1041, section 5, shall be implemented immediately 1 22 following approval. 1 23 2. The department of human services, in 1 24 consultation with the personal assistance and family 1 25 support services council created in section 225C.48, 1 26 shall submit a waiver request to the United States 1 27 department of health and human services for approval 1 28 of funding of services provided to persons with 1 29 physical disabilities through the medical assistance 1 30 home and community-based services waiver, including 1 31 consumer-directed attendant care services. If 1 32 approved, the services, as provided in 1994 Iowa Acts, 1 33 chapter 1041, section 5, shall be implemented 1 34 immediately following approval. The department shall 1 35 use existing state funds to draw down federal funds 1 36 for the consumer-directed attendant services. The 1 37 department shall not propose or implement the medical 1 38 assistance home and community-based waiver for 1 39 services for persons with physical disabilities in a 1 40 manner which would require county funding to match 1 41 federal funding. The nonfederal funding match shall 1 42 be provided only through expenditure of state funds 1 43 from existing human services programs, including but 1 44 not limited to the in-home-health-related program and 1 45 other programs which are funded solely through 1 46 expenditure of state funds. 1 47 Sec. 200. PERSONAL ASSISTANCE SERVICES &endash; 1 48 APPROPRIATION. There is appropriated from the general 1 49 fund of the state to the department of human services 1 50 for the fiscal year beginning July 1, 1995, and ending 2 1 June 30, 1996, the following amount, or so much 2 2 thereof as is necessary, to be used for the purpose 2 3 designated: 2 4 For the personal assistance services program 2 5 created in section 225C.46: 2 6 .................................................. $ 2,889,723"" 2 7 #2.
