1 3 #1. Page 7, by striking lines 13 through 29 and
1 4 inserting the following:
1 5 "10. a. Beginning September 1, 1995, the
1 6 department may require prior authorization for any
1 7 brand name prescription drug which has an "A" rated
1 8 generic bioequivalent as determined by the federal
1 9 food and drug administration and which is recommended
1 10 for prior authorization by the drug utilization review
1 11 commission. The department shall establish an
1 12 educational program through the drug utilization
1 13 review commission to review and encourage the use of
1 14 these "A" rated generic equivalents within the medical
1 15 assistance program. The department shall adopt
1 16 administrative rules to implement the prior
1 17 authorization provisions of this paragraph. Beginning
1 18 January 1, 1996, prior authorization shall not be
1 19 required for clozapine. The department shall consider
1 20 expert medical opinion in revising administrative
1 21 rules applicable to clozapine.
1 22 b. The department of human services shall, when it
1 23 is economically beneficial, implement maximum
1 24 allowable costs for multiple source drugs in
1 25 accordance with federal guidelines.
1 26 c. The department shall require prior
1 27 authorization for full therapeutic dose levels of
1 28 histamine H2 receptor antagonists and sucralfate
1 29 beyond 60 days of therapy.
1 30 d. The department shall review the feasibility of
1 31 assuming responsibility for administratively pursuing
1 32 reimbursement for pharmacy services for which a
1 33 recipient of medical assistance also has third-party
1 34 coverage. The department shall submit a report of the
1 35 department's findings and recommendations to the
1 36 chairpersons and ranking members of the joint
1 37 appropriations subcommittee on human services on or
1 38 before January 15, 1996."

2 31 legislative session. The recommendations shall
2 32 address how much of the funding should be directed to
2 33 families trying to keep their children with
2 34 disabilities in the family home, potential
2 35 administrative rule revisions to improve the program,
2 36 and actions for the department to take to inform
2 37 families about the program."
