1 12 in an escrow account, a letter of credit, a bond, or
1 13 an insurance policy, which shall be used as provided
1 14 in section 455B.205."

1 17 "Sec. . NEW SECTION. 455B.205 FINANCIAL
1 18 ASSURANCE REQUIRED.
1 19 A person who receives a permit under section
1 20 455B.173 must establish and at all times maintain
1 21 financial assurance in a form required by the
1 22 department which may include the deposit of moneys in
1 23 an escrow account, a letter of credit, a bond, or an
1 24 insurance policy, as provided upon such terms and
1 25 conditions as the department requires. The amount of
1 26 the financial assurance shall equal one cent for each
1 27 gallon of capacity of all structures connected to the
1 28 operation which are used to store manure as part of an
1 29 animal feeding operation required to be constructed
1 30 pursuant to a permit issued by the department pursuant
1 31 to section 455B.173. The department shall require
1 32 that the financial assurance shall be used for
1 33 purposes of paying costs of removing and disposing of
1 34 the manure from a manure storage structure. The
1 35 department shall oversee the removal and disposal of
1 36 the manure, and may use the financial assurance to pay
1 37 for the work by a qualified person based upon bids let
1 38 by the department. The department shall use the
1 39 financial assurance if the permittee liquidates assets
1 40 including in bankruptcy, to the extent allowed by
1 41 federal law; the operation is abandoned; or there is
1 42 evidence that the operation is threatening the quality
1 43 of groundwater or surface water, and there is
1 44 compelling evidence that the permittee is incapable or
1 45 unwilling to remedy the cause of the pollution in a
1 46 timely manner."
