1 1 Amend the amendment, H-3327, to House File 166 as
1 2 follows:
1 3 #1. By striking page 1, line 4, through page 3,
1 4 line 49, and inserting the following:
1 5 ""Section 1. INTERIM STUDY &endash; REGULATION OF
1 6 PRIVATE PROPERTY.
1 7 The legislative council is requested to establish
1 8 an interim study committee to consider issues related
1 9 to the effects of state governmental regulations, and
1 10 especially rules adopted by state agencies, upon the
1 11 fair market value of private property and restrictions
1 12 upon the uses of that property, including but not
1 13 limited to property which is used for agricultural
1 14 purposes. The committee shall consider the extent to
1 15 which state regulations may trigger constitutional
1 16 taking provisions requiring compensation be paid to
1 17 the owner under either the fifth or fourteen
1 18 amendments to the Constitution of the United States,
1 19 or Article I, section 18, of the Constitution of the
1 20 State of Iowa, and the extent to which owners of
1 21 private property should be compensated, if regulation
1 22 restricts an interest in property, but does not
1 23 trigger a constitutional taking. The committee shall
1 24 review methods to encourage agencies to establish
1 25 procedures to minimize the impact of regulations upon
1 26 private property owners while carrying out purposes
1 27 and goals of the regulations in a practical and cost-
1 28 effective manner. The committee shall report to the
1 29 general assembly not later than January 1, 1996. The
1 30 report shall contain findings and may include
1 31 recommendations, including legislative proposals.""

1 33 inserting the following: "private property owners due
1 34 to constitutional takings of or use restrictions on
1 35 private property through governmental action by
1 36 providing for a study and a report to the general
1 37 assembly."
