PAG LIN 1 1 Amend House File 528 as follows: 1 2 #1. By striking page 6, line 9, through page 7, 1 3 line 4, and inserting the following: 1 4 "Sec. . Section 232.45A, subsections 2 and 3, 1 5 Code 1995, are amended to read as follows: 1 6 2. Once a child sixteen years of age or older has 1 7 been waived to and convicted of an aggravated 1 8 misdemeanor or a felony by the district court, all 1 9 criminal proceedings against the child for anyfelony1 10 offense occurring subsequent to the date of the 1 11 conviction of the child shall begin in district court, 1 12 notwithstanding sections 232.8 and 232.45. A copy of 1 13 the findings required by section 232.45, subsection 8, 1 14 shall be made a part of the record in the district 1 15 court proceedings. 1 16 3. If proceedings against a child for afelony1 17 public offense who has previously been waived to and 1 18 convicted of such an offense by the district court are 1 19 mistakenly begun in the juvenile court, the matter 1 20 shall be transferred to district court upon the 1 21 discovery of the prior waiver and conviction, 1 22 notwithstanding sections 232.8 and 232.45." 1 23 #2.
