PAG LIN 1 1 Amend House File 258 as follows: 1 2 #1. Page 2, by inserting after line 16 the 1 3 following: 1 4 "Sec. . Section 730.5, Code 1995, is amended by 1 5 adding the following new subsection: 1 6 NEW SUBSECTION. 3A. An employer shall establish 1 7 the following training programs prior to instituting 1 8 drug testing as allowed by this section. 1 9 a. An employer shall provide all employees with an 1 10 educational program on alcohol and drug abuse. An 1 11 employer shall provide all employees with an annual 1 12 educational program on alcohol and drug abuse, in 1 13 general, and the effects of alcohol and drug abuse on 1 14 the workplace, specifically. An educational program 1 15 shall include a minimum of one hour of instruction 1 16 which shall include, but is not limited to, an 1 17 explanation of the disease of addiction for alcohol 1 18 and other drugs, the effects and dangers of the 1 19 commonly abused substances in the workplace, and the 1 20 employer's policies and procedures regarding alcohol 1 21 and drug use or abuse in the workplace and how 1 22 employees may obtain substance abuse treatment. 1 23 b. An employer shall provide all supervisory 1 24 personnel with a minimum of two hours of training each 1 25 year on alcohol and drug abuse. The training shall 1 26 include, but is not limited to, information on 1 27 recognition of evidence of employee alcohol and other 1 28 drug abuse, documentation and corroboration of 1 29 employee alcohol and other drug abuse, referral of 1 30 alcohol and other drug-abusing employees to the proper 1 31 treatment providers, and the recognition of the 1 32 benefits of referring alcohol and other drug-abusing 1 33 employees to treatment programs, in terms of employee 1 34 health and safety and employer savings. 1 35 The governor's alliance on substance abuse shall 1 36 develop educational programs to meet the requirements 1 37 of this subsection and shall make the programs 1 38 available to businesses upon request. The governor's 1 39 alliance on substance abuse shall monitor the 1 40 effectiveness of these programs and provide an annual 1 41 report to the general assembly." 1 42 #2.
