1 2 #1. Page 2, line 7, by inserting after the word
1 3 "alcohol." the following: "For the purposes of this
1 4 paragraph, a pattern of errors of judgment or mistakes
1 5 involving the performance of a supervisor's,
1 6 manager's, or officer's job shall constitute a
1 7 reasonable belief that a supervisor's, manager's, or
1 8 officer's faculties are impaired on the job. This
1 9 determination shall be made by a committee of
1 10 employees at the time of the supervisor's, manager's,
1 11 or officer's annual job performance review."
1 12 #2. Page 2, by inserting after line 16, the
1 13 following:
1 14 "Sec. . Section 730.5, Code 1993, is amended by
1 15 adding the following new subsection:
1 16 NEW SUBSECTION. 3A. If an employer subjects one
1 17 group of employees to drug tests as provided in
1 18 subsection 3, 5, or 7, all employees, supervisors,
1 19 managers, officers, and directors shall be subject to
1 20 drug tests on the same conditions."
1 21 #3. By renumbering as necessary.
