  1  1    Amend the amendment, H-3109, to House File 2, as
  1  2 follows:
  1  3    #1.  Page 5, line 16, by inserting after the word
  1  4 "trial." the following:  "Both the state and the
  1  5 defendant shall have the right to present opening
  1  6 statements at the commencement of the penalty
  1  7 proceedings."
  1  8    #2.  Page 5, by striking lines 21 through 24 and
  1  9 inserting the following:  "902.12 and any aggravating
  1 10 circumstances.  The state shall".
