House Amendment 3151

  1  1    Amend the amendment, H-3109, to House File 2, as
  1  2 follows:
  1  3    #1.  Page 7, by striking lines 29 through 31 and
  1  4 inserting the following:  "any of the following, the
  1  5 court shall enter".
  1  6    #2.  Page 7, line 36, by striking the figure "5."
  1  7 and inserting the following:  "5:
  1  8    a.  That the defendant did not directly commit the
  1  9 murder and the defendant did not intend to kill or
  1 10 anticipate that lethal force would be used.
  1 11    b.  That the defendant's capacity to appreciate the
  1 12 wrongfulness of the defendant's conduct and to conform
  1 13 that conduct to the requirements of law was
  1 14 significantly impaired as a result of a mental disease
  1 15 or defect or mental retardation, but not to a degree
  1 16 sufficient to constitute a defense.
  1 17    c.  That the defendant acted under extreme duress
  1 18 or under the substantial domination of another
  1 19 person."
